Stating the obvious !! D & C contracts where clients or architects try and shift all the risk to the builder can be counter productive. Sure, there’s still a place for it, but be sensible - No one wants broke builders….! As stated by Spyre’s Andrew Malouf : “The whole concept of a D&C [design and construct] is dead, a lot of people are looking at something like a construct-only with some design liability, it’s not a circumstance where we can put the whole onus on the builder anymore.”
