  • Ellie White, from our Gold Coast team, successfully secured a time extension application for a worker whose initial claim was rejected. Such extensions are rarely granted, highlighting the exceptional nature of this outcome. The discretion to extend time limits is carefully used to mitigate undue hardship from strict adherence to deadlines. The Regulator granted the extension based on two pivotal factors: (a) the worker’s medical incapacity due to aggravated symptoms of anxiety and depression from work-related stress and injuries, and (b) the claimant’s financial hardship obstructing the preparation of the review application. During the subsequent hearing at the MAT, with both written and oral submissions presented by Sugath Wijedoru and Ellie White, the MAT recognised that the client had suffered a workplace injury due to the demands of heavy work. This led to the overturning of WorkCover's initial decision to reject the claim. The claimant is now entitled to be evaluated for permanent impairment and pursue a common law claim for damages, as a result of what the MAT acknowledged were heavy work duties.
