    When people learn that I do criminal law, they often make a joke along the lines of, "oh so you keep the criminals ON the streets!" I politely laugh (haha yes exactly! What an astute and accurate observation!) but really, I want to say something along the following lines... I help to keep the people deserving of a second chance on the streets. Granted, there are clients I represent who belong in prison and there is no alternative, but they are few and far between. The majority are kind, genuine and reasonable people who have ended up in Court due to one bad decision. It's the client who waits until the next day to drive but is still over the limit, it's the client who defends himself in a pub fight but hits the other person a little too hard, it's the client whose friends encourage him to buy drugs at a nightclub, it's the client who suffers from complex mental health issues or drug and alcohol abuse, it's the client who lashes out against her abuser after years of domestic violence. I have had countless clients who have never been in trouble with the police before, and they are terrified and confused and desperate for help. They are mothers, fathers, husbands, wives, grandparents, friends, and colleagues. It is our job as lawyers to listen to their story without judgment, and fight for the best outcome based on their unique circumstances.   • MYTH: I have a Will, so if I lose decision-making capacity while I'm alive, my executor will just pay my bills and manage my finances. FACT: A Will has no legal effect until you die. The executor of your Will has no power or authority whatsoever to make any financial or legal decisions for you while you are still alive. If you want your executor or another person to make these sorts of decisions on your behalf if you lose capacity, you must appoint them as your attorney under a valid Power of Attorney document. MYTH: I'm married, so if I lose decision-making capacity while I'm alive, my husband/wife will just pay my bills and manage my finances. FACT: Marriage does not override the requirement for a Power of Attorney. If you lose capacity or otherwise require assistance with financial decisions, your spouse will not automatically be authorised to make these decisions for you. Instead, they would be required to apply to the NSW Civil and Administrative Tribunal (NCAT) for a financial management order which can be a long and complex process. MYTH: I have appointed an attorney under a Power of Attorney document, so if I lose decision-making capacity, my attorney will decide where I live and what healthcare I receive. FACT: In NSW, an attorney cannot make health, medical or lifestyle decisions for you. In order to appoint someone to make these decisions for you if you lose capacity, a separate document is required, namely an Appointment of Enduring Guardian document.   • ✋🏼🛑🚙 Before you decide to court-elect a penalty notice, you should seek legal advice about the possible consequences. If you receive a penalty notice for an offence like speeding, going through a stop sign or using your mobile phone, you might be thinking about taking the matter to court to avoid paying the fine or incurring the demerit points. If you court-elect a penalty notice, you are asking the court to deal with you as if it was a criminal matter. This means that you have to plead guilty or not guilty to the offence. More often than not, the offence has been caught on camera, so a guilty plea should be entered. From there, you can ask the Court to dismiss the matter without recording a conviction against you (known as a “Section 10”). While this may be possible if you have a spotless traffic record, you could instead be convicted of the offence. This means that you will incur the demerit points, pay what could be a BIGGER fine (the Court has the power to do this) and leave Court with a criminal record. You could also be hit with court costs.     A question I am often asked by friends, family and colleagues is “how do you work in family law? Isn’t it depressing?” My answer is usually yes, and I have gone so far as to tell junior solicitors not to work in the field because of this (and other reasons). The fact is, while family law can be downright depressing, overwhelming, intense, emotional and unforgiving, it is also extremely rewarding, meaningful, relevant, interesting and challenging in the best possible way. When I studied law at university, we were required to choose between criminal law and family law for the practical component of the Diploma of Legal Practice. Without a second thought, I chose criminal law, as there was nothing about family law that appealed to me in any way. Fast forward to now, and I couldn’t give it up. BUT I also couldn’t work solely in family law, because there is no denying how hard it is. It is hard on you mentally when a Judge is firing questions at you that you may not have the answers to. It is hard on you intellectually because the law is particularly complex and ever-changing. It is hard on you emotionally when a client hasn’t seen their children in months or worse still, has their children taken away from them. Or when a woman who has suffered domestic violence is locked out of the family home by her abuser. Or when a client calls you in tears because their ex has threatened to “take them for all they’re worth”. It’s the flip-side that makes me want to keep doing it until I retire. It’s the feeling you get when your client is reunited with their child, or awarded a fair settlement that allows them to start fresh. It’s the feeling of working tirelessly on a matter for YEARS and finally getting the client the outcome they deserve. Most importantly, it’s being a part of a system which, despite its flaws, plays an integral part in keeping children and families safe and raising awareness of domestic violence and the impact it has on all of us. So yeah, family law is depressing. But I love it. #familylaw #familylawyer #domesticviolenceawareness
