In a landmark decision handed down on 11 December 2024, a majority of the High Court of Australia found in Elisha v Vision Australia Limited [2024] HCA 50 that an employer breached an employment contract by way of its manner of investigating and ultimately dismissing an employee for alleged misconduct and is consequently liable for an associated psychiatric injury. This raises important contractual considerations for employers when investigating and dismissing employees.
