In a recent case, the Court of Appeal clarified the scope of access to the benefit of the uninsured liability scheme. The court ruled that access to the scheme is restricted to claims involving "injuries" as defined under the 1987 Act, excluding dust diseases like silicosis. This decision offers important clarity for litigants in dust disease cases, particularly where employers are uninsured, by confirming that the uninsured liability scheme is not liable to cover claims for common law damages related to dust diseases. In October 2024, the Administrative Review Tribunal Act 2024 (Cth) established the new Administrative Review Tribunal (Tribunal), which included a new form of appeal known as the Guidance and Appeals Panel (GAP).
