In this Law360 expert analysis, Sarah Tsou and Will Freeman discuss how, contrary to recent news suggesting that third-party litigation finance providers are “fleeing” the District of Delaware because of Chief Judge Connolly’s standing order regarding third-party litigation funding arrangements, litigation funders have no reason to fear disclosure and embrace the District of Delaware as an experienced and viable venue. Omni Bridgeway is delighted to welcome Grace Barry to the team. Based in Melbourne, Grace will focus on due diligence and the management of investments across a number of industry sectors. We asked Grace a few questions to get to know her a little better. Q: Why did you decide to move from private practice into the world of funding? I saw the transition from private practice into litigation funding as an incredible opportunity to work for an industry leader while leveraging my legal experience in a more strategic and impactful way. The transition also provides the opportunity to work on a diverse range of cases, support Omni Bridgeway’s clients in accessing the resources needed to pursue claims and be involved in an exciting area that is rapidly evolving. Q: What was the highlight of your time working at Maurice Blackburn Lawyers? It’s difficult to pick a single highlight from my time at Maurice Blackburn. The opportunity to work on complex cases alongside a talented and collaborative team was a consistent highlight during my time there, as was the ability to contribute to meaningful and positive outcomes supported by the firm’s unwavering commitment to excellence. Q: What is the best piece of advice you have ever gotten at work? Be accountable, be transparent and the rest will follow. That and read the footnotes! The answer is always in the footnotes. Q: What movie do you wish you could watch again for the first time? I would watch Life is Beautiful again for the first time – it’s one of those movies that stays with you, and is such a perfect blend of beauty, sorrow and humour. Q: What did you want to be when you grew up? I always knew I wanted to do something that was either in the law or in finance, or some combination of both. What makes this opportunity particularly exciting is that it feels like the best of both worlds. #legalfinance #litigationfunding

Omni Bridgeway's Marijn Flinterman will chair this panel discussion. Asset recovery practitioners know all too well that debtors are constantly coming up with new escape routes to flee from or resist asset recovery strategies. The panel will discuss common (and uncommon) defences that are typically raised and how they can be tackled and conquered by creditors. Panelists will consider, for example: - the use (or misuse) of restructuring plans; - what creative strategies might be deployed to enforce judgments/awards against difficult debtors; - issues around establishing ownership; - surpassing the challenges of piercing the corporate veil and alter ego arguments; and - defeating third-party interference. The expert panel is made up of Ioannis Alexopoulos, Signature Litigation; Wendy Lin, WongPartnership LLP; Alexander Troller, LALIVE; and Amala Umeike of Stren & Blan Partners. This session forms part of the International Bar Association's 2nd Annual Asset Recovery Conference.
