An important consideration for individuals and employers in relation to how both authorities and appeals bodies view risk in the context of historic offending, and dispelling the notion that old conduct is excused by the passage of time.
A teacher, who was convicted of offences against a child 29 years ago, has had their application for a working with children check (WWCC) refused. 🔹The teacher applied for a WWCC, which the NSW Office of the Children's Guardian refused. The Guardian said the previous conviction gave rise to a presumption that the teacher was not suitable for a WWCC. 🔹On appeal to the NSW Civil and Administrative Tribunal (NCAT), the teacher argued that the passage of time (29 years) had displaced the presumption of unsuitability; and that they no longer presented a risk to children. 🔹 The NCAT Members, in their findings, said the teacher had "not rebutted the presumption that he [posed] a real and appreciable risk to the safety of children. SafeWork inspectors are ramping up checks on psychological heath and safety in NSW workplaces. When inspectors respond to a request for service in organisations with 200 or more workers, including the public sector, they will now do a check to see if the workplace is meeting its duty to manage psychosocial hazards. This includes if the purpose of the visit is unrelated to psychological health and safety. We will take regulatory action against any workplaces that do not comply. A surge in assaults on residential care workers being abused and threatened by children has sparked a rise in compensation claims in Queensland, the Courier-Mail reports. Our North Lakes-based Special Counsel Beverley Evans spoke to the Courier-Mail about the "recognisable increase" she had seen in carers being injured at work, having spent 25-30 years in personal injury law. Former carer Jane, whose name was changed to protect her identity, bravely shared her story of how she was dragged to the ground and had threats made against her family by juveniles at a residential care home in Caboolture. Results released by the Workplace Gender Equality Agency review show one in four employers is still failing to monitor the prevalence of sexual harassment in the workplace. Why is this the case? Silos. Most organisations still manage sexual harassment allegations as an individual beahvioural issue - not a systemic safety issue. As a result, complaints about sexual harassment are often not addressed, managed, or evaluated from a safety management systems perspective. Managing work related violence means addressing hazards from the dual lenses of psychosocial and physical risk.
We partnered with National Disability Services and QUT (Queensland University of Technology) to better understand work-related violence (WRV) in the residential disability sector.
