Crossborder talk about IP! As part of the royal mission to Brazil, brantsandpatents had the privilege of meeting with Brazilian colleagues to discuss global trends and innovative strategies in intellectual property. Led by Johan Brants, the discussions provided valuable insights into the future of IP and opportunities for international collaboration. We extend our thanks to our hosts Msantos Intellectual Property for their hospitality and the productive exchange of ideas, and we look forward to be at the forefront of delivering excellence in IP.

Congratulations to Ellen Crabbe on being promoted to Chief Operating Officer (COO) at brantsandpatents! Ellen will continue to work closely with CEO Johan Brants to lead brantsandpatents forward as a top-tier IP office in Belgium and steer it into the future. Time for part two of our blog on SPCs and European caselaw! To have a valid SPC, Article 3(a) of the SPC Regulation requires that the product is covered by a basic patent. While this may look like a straightforward requirement, practice has taught us that it is not. Debate about Article 3(a) requirements has led to a series of decisions of the European Court of Justice. SPCs or supplementary protection certificates provide additional protection (beyond the regular 20 years) to patents in the field of pharmaceuticals and crop protection. European SPCs are governed by Regulation (EC) N° 469/2009 for pharmaceutical inventions and Regulation (EC) N° 1610/96 for plant protection compounds, in short referred to as the SPC regulation. Article 3 of the SPC regulation can be considered the 'heart' of the regulation, explaining the conditions for obtaining valid SPC protection.
