Our European member organisations are part of the umbrella network of BEUC, the European Consumer Organisation. Together we advocate for EU policies that benefit consumers in their daily lives.

Tuesday 28 January 2025:   🔹 Euroconsumers and Altroconsumo publish an analysis of DeepSeek’s data policies which identifies breaches of GDPR and serious concerns about consumers’ data security and protection. 🔹  Euroconsumers and Altroconsumo submit the report to Garante – the Italian data protection authority and request a temporary restriction on the service. 🔹 Garante sends a formal request to DeepSeek for more information on their data practices and potential infringements of EU data law Wednesday 29 January 2025: Euroconsumers member Testachats / Testaankoop issues complaint on DeepSeek’s data usage policies to the Belgian Data Protection Authority (ADP) Thursday 30 January 2025:  🔹 Belgium’s Data Protection Authority launches an investigation into DeepSeek 🔹  Italy’s Data Protection Authority blocks DeepSeek  🔹 Euroconsumers member Deco Proteste files complaint on the same basis to its National Data Protection Commission, the CNDP Friday 31 January 2025:  🔹 Euroconsumers Spanish member OCU files a complaint to AEPD – Spain’s data protection agency 🔹  Euroconsumers’ members in Spain, Belgium and Portugal will point to the decision of the Italian DPA and ask for similar action in their countries.

    Like many we are concerned to see the European Commission has suggested to withdraw the #AI Liability Directive. ▶️ Without clear rules outlining who is responsible when something goes wrong both consumers and businesses, particularly SMEs, are left scrambling in the dark. Is that really promoting an innovative AI space? ▶️ In order to embrace the benefits AI, consumers need to feel protected if something goes wrong. Without clear liability rules, the existing legislation does not help ensure consumers have access to fair compensation. ▶️ Without liability there is no proper #enforcement, without proper enforcement no effective legislation. As consumer group with a long lasting on-ground experience in helping consumers getting redress when something goes wrong, euroconsumers has learned this the hard way. 💡 This is not just rules for the sake of rules; but rules to empower both consumers and businesses to embrace the potential of AI

    The Commission put the AI Liability Directive on the chopping block. What happens now? As Šefčovič said today: "This is our invitation to the co-legislators, tells us: do you want to work on this AI liability proposal?" A few insights on how we got here and the next steps. First, it is worth noting that the narrative that this decision was somehow a direct consequence of what this or that person said at the AI Summit in Paris is misguided. Lack of clarity on the added value and overlap with the Product Liability Directive, which includes software (incl. AI), plagued the file from the start. Still, AI was a sexy topic and someone wanted to jump on this hype. Thus, the PLD was largely neglected, while all eyes went to the AILD. Since the AILD was closely linked to the AI Act, the co-legislators put it on hold until the regulation was finally agreed. After the actual work started, it quickly hit a wall in the Council, as France & others questioned whether it was needed. This opposition started to build up also within the Commission. Still, the AILD has been stalling for a little over a year, whereas in other files, it took much longer for the Commission to drop the ball. Why the rush, then? The reason is that the decision was mostly political. The climate in Brussels has completely changed with the new term. Despite having the same president and an almost identical political majority, this Commission is doing its best to dismantle what the previous one has done. Ironically, what made the AILD the perfect sacrificial victim on the altar of "simplification" is what brought it about in the first place: it was as appealing to regulate AI in the previous term as it is now to cut rules on this disruptive tech. The fact that the file was likely ill-conceived from the start made this easier. But that doesn't mean it was completely without merit. For example, the AI Act also covers fundamental rights, but the PLD only applies to material damages. The AILD tried to fill that gap. The question of how liability will be distributed in the complex AI value chain also deserves attention and was one of the key points the European Parliament was posed to deal with. The rapporteur, Axel Voss, already voiced his disappointment for the Commission's decision. So, what happens now? As Šefčovič said, if both institutions want to keep working on the file, they can. But as things stand in the Council, it seems unlikely. The MEPs of the responsible committee could invite the relevant Commissioner (McGrath) to discuss the decision and request a statement. In practice, that wouldn't change much. A more extreme option would be to challenge the decision before the EU Court of Justice, but a past case (C-409/13) left the Commission ample discretion. Brief, this is probably the end of the AILD saga. We will never know if it could have been turned into something meaningful. Hopefully, it will stand as a warning that chasing the media hype is not a solid ground for policymaking.
