New jurisdiction regarding COVID-19 as an accident at work The Austrian Supreme Court has explained that infectious diseases, including COVID-19, cannot generally be classified as accidents at work unless caused by an accidental event. The ruling emphasizes that while COVID-19 is recognized as an occupational disease, it typically arises from long-term exposures rather than abrupt infections. Mental Health at Work: European Forum’s Position The European Forum of the Insurance Against Occupational Accidents and Diseases has expressed concerns regarding the classification of anxiety, depression, and burnout as occupational diseases. They emphasize that these conditions often arise from a variety of factors, not solely from workplace-related causes. The Forum calls for further research into the connections between mental health and working conditions and points out that the WHO classifies burnout as a syndrome rather than a disease. They warn against transforming recommendations into binding regulations, as the recognition and compensation for occupational diseases are managed by the member states.
