The second draft is based on the feedback received on the first draft which was published on 14 November 2024. The Chairs emphasised that the second draft remains a work in progress which focused primarily on providing clarifications and aligning to the principle of proportionality, such as the size of the general-purpose AI model provider. A third draft can be expected for the week of 17 February 2025. https://lnkd.in/ew2fHCH6 💾 On 18 December, the European Data Protection Board adopted an opinion on the use of personal data for the development and deployment of AI models. This opinion considers (i) when and how AI models can be considered anonymous, (ii) whether and how legitimate interest can be used as a legal basis for developing or using AI models, and (iii) what happens if an AI model is developed using personal data that was processed unlawfully. The opinion sets out a three-step test to help assess the use of legitimate interest as a legal basis. When an AI model has been developed with unlawfully processed personal data, this could have an impact on the lawfulness of its deployment, unless the model has been duly anonymised. https://lnkd.in/dwv-v_Kj 🔐On 10 December 2024, the Cyber Resilience Act entered into force. The CRA introduces mandatory cybersecurity requirements for manufacturers and retailers of products that contain a digital component, governing the planning, design, development, and maintenance of such products. Some critical products of particular relevance for cybersecurity will also need to undergo a third-party assessment by an authorised body before they are sold in the EU market. 🌐 European Data Protection & Cybersecurity Update Recent actions and publications by the European Data Protection Board (EDPB) and the European Commission signal a robust push towards enhancing data protection and cybersecurity across the EU: [Data] EDPB Embraces GDPR Application Report: The EDPB has welcomed the European Commission's second report on the General Data Protection Regulation (GDPR) application, emphasising the importance of legal certainty and the coherence of digital legislation with GDPR. The EDPB is actively clarifying the enforcement interplay of GDPR with the AI Act, the EU Data Strategy, and the Digital Services Package, while also committing to produce more accessible content for non-experts and SMEs. This initiative aims to support organisations in navigating the complex landscape of data protection. [Flow] Guidelines on Data Transfers & European Data Protection Seal: The EDPB published guidelines on Article 48 of the GDPR, addressing data transfers to third-country authorities, and approved a new European Data Protection Seal. These guidelines assist organisations in assessing requests from non-European country authorities, with ensuring GDPR compliance. [Cyber] NIS2 Directive Transposition Call: The European Commission has urged 23/27 EU Member States to fully transpose the NIS2 Directive into national law, aiming to ensure a high level of cybersecurity across critical sectors in the EU.
