  • Since January 2023, Timelex has been contributing to the TrustChain project, an ambitious EU-funded initiative that aims to build a secure, sustainable and human-centric internet by developing advanced Next Generation Internet protocols and decentralised software solutions. The project addresses critical challenges, such as trustworthy digital identities, secure and resilient data pathways, energy-efficient data sharing, and the creation of a new data governance model in line with European values and regulations. Top Internet innovators are selected for funding and support through 5 open calls. Each of these calls support the development of cutting-edge solutions to break down data silos, ensure interoperability and explore privacy-preserving Web3 and blockchain technologies. Currently, the 5th and final Open Call—focused on green, scalable, and sustainable Distributed Ledger Technologies (DLTs)—is open for applications until 15 January. Read more in our blogpost: https://lnkd.in/dJyj999Q As the legal partner, Timelex supports the TrustChain consortium by: ·      Evaluating privacy, data protection and compliance with key EU regulations, including the eIDAS Regulation and the NIS2 Directive. ·      Developing a practical framework for assessing compliance and using the innovative results of the project to identify gaps in the regulatory framework. ·      Providing actionable recommendations for refining the regulatory framework to promote a robust legal environment that supports innovation while safeguarding human rights and European values. Honoured that in its judgement of 28 November 2024 the Belgian Constitutional Court followed my argumentation (representing the Belgian Ministry of Finance) that the Belgian Data Protection Authority does not have discretionary power to decide in which language proceedings before the DPA are conducted. Article 57 of the Belgian DPA Act provides that the DPA can decide which language parties have to use depending on the needs of the case, thus giving the DPA discretionary power to decide on the procedural language to be used. Pursuant to this Article, the Belgian DPA drew up a 9-pages Language Policy. I argued that this Article 57 and Language Policy violate Article 30 of the Belgian Constitution, which provides that rules on languages have to be set forth in an Act of Parliament, not in a policy drafted by an administrative governmental agency. The Constitutional Court now finds that Article 57 of the Act indeed violates Article 30 of the Constitution. Its legal basis having been declared unconstitutional, the Belgian DPA may now no longer apply its Language Policy. The Constitutional Court rules that the DPA has to apply the usual language legislation that applies to most administrative governmental agencies. The judgement is available here : https://lnkd.in/evamJxgr (Dutch) and https://lnkd.in/eATGKdEn (French) #GDPR #data #dataprotection #privacy
