The parallel European Commission and UK Competition and Markets Authority investigations into concerns that Vifor may have abused its dominant position through disparagement of a rival product underscore the need for pharmaceutical companies to avoid potentially misleading claims about competitors in their marketing campaigns and medical communications. Both agencies have now given further indications of when disparagement may raise competition concerns – the Commission in the non-confidential version of its decision accepting commitments offered by Vifor to resolve allegations of disparagement and the CMA in its recent notice provisionally accepting broadly similar commitments proposed by Vifor, open for consultation until 17 January 2025.
