    📣The European Commission invites comments ✍️on commitments offered by Corning to address competition concerns over its alleged exclusive dealing practices in relation to the supply of Alkali-aluminosilicate glass, a special type of glass mainly used as cover glass in handheld electronic devices 📱 ▪️ The Commission will publish a summary of the proposed commitments in the EU’s Official Journal on 29 November and invites all interested parties to submit their views until 13 January 2025  📅. 🔗 https://lnkd.in/dBDP3Tz   ▪️ The full text of the commitments, a summary of the commitments that Corning committed to deliver (Notice to Stakeholders), and the list of addressees of that notice will be available on the Commission's competition website 🔗 https://lnkd.in/eMwD8zTV ▪️ On 6 November 2024, the Commission opened a formal investigation over concerns that Corning may have distorted competition in the market for Alkali-AS Glass by concluding anticompetitive exclusive supply agreements with mobile phone manufacturers and with companies that process raw glass. ▪️ The Commission preliminarily found that Corning is dominant on the worldwide market for Alkali-AS Glass. ▪️ According to the Commission's preliminary assessment, Corning has abused its dominant position in breach of Article 102 of the Treaty on the Functioning of the European Union (‘TFEU'). ▪️ To address the Commission’s competition concerns, Corning has offered a range of Commitments, that would be applicable worldwide 🌍and would remain in place for nine years   Text of the Press Release can be found here 🔗https://lnkd.in/eQp5beqP #EUAntitrust #Commitments #Article102

    Relaunching European Competitiveness through the Green Transition ❓ This week, DG Competition participated in a panel at the European Business Summits 2024 dedicated to addressing this critical question. Together with esteemed co-panelists Leena Yla-Mononen, Nicoló Giacomuzzi-Moore, Przemysław Jastrzębski, and Holger Kreetz, DG COMP's Director-General, Olivier Guersent, shared key insights. Here below are the main points ⬇ 🌍 Europe’s future competitiveness depends on successful decarbonisation and ensuring a just transition. To support this, we need a modern approach to competition policy. ♻ A Clean Industrial Deal will be pivotal for the green transition. It will include a new State aid control framework to accelerate renewable energy roll-out, industrial decarbonisation, and clean-tech manufacturing capacity. 🚀 European competitiveness relies on companies achieving the right scale to innovate and grow, but this must not undermine fair competition—the cornerstone of resilience and innovation. 🏢 SMEs remain the backbone of EU policy, with tailored competition rules ensuring their access to markets, finance, and innovation. ⚡ Adaptability is essential: As global challenges evolve, competition policy must remain agile to bolster resilience, innovation, and productivity across Europe. #EUCompetition #EBS2024

    🔴 The European Commission publishes findings of evaluation of the EU competition rules on technology transfer agreements 👇 📄 Here below you can find the Staff Working Document that summarises the findings of its evaluation of the Technology Transfer Block Exemption Regulation (‘TTBER') and the accompanying Guidelines on the application of Article 101 of the Treaty to technology transfer agreements. Main findings ⬇ 📌 The TTBER and the Guidelines have been largely successful in ensuring the effective, efficient and uniform application of EU competition rules to technology transfer agreements. 📌 The objectives of the TTBER and the Guidelines remain relevant. The evaluation also shows that the TTBER and the Guidelines could be improved in certain areas. ➡ The Commission will now launch the impact assessment phase to look into the issues identified during the evaluation. 📅 Stakeholders can comment on the call for evidence and provide their views in the context of a public consultation, which is currently planned for December 2024.     📄 DG Competition has published the final report on “Barriers to Demand Response Participation in Electricity Markets and State Aid Support” 👇 Why demand response matters ❓ ⚡ Demand response empowers consumers to adjust their electricity consumption, either increasing or decreasing, in response to market signals. 💶 Recognised as a vital flexibility tool, demand response helps ensure that the electricity supply is stable, secure and affordable. 📌 By activating consumer participation, Member States can mitigate price fluctuations and prevent the costly curtailment of renewable energy production. 🚧 The study identifies key barriers to demand response participation in electricity markets and State aid mechanisms, such as market-wide capacity mechanisms. ℹ The report provides valuable findings for stakeholders designing non-fossil flexibility measures on how to provide equal opportunities for flexibility services providers, without undue distortions of competition and trade.     Last week, DG Competition took part in the 2024 International Competition Network (ICN) Merger Workshop in Taipei 👇 🤝 The event brought together competition officials from agencies worldwide, along with their non-governmental advisors (NGAs), creating a valuable platform for discussing key topics in merger control. DG COMP officials were joined by NGAs Viktoria (Vicky) Robertson and Salomé Cisnal de Ugarte. 📑 As a co-chair of the ICN Merger Working Group, DG Competition is actively leading efforts to update the ICN Recommended Practices for Merger Analysis, with a focus on chapters addressing unilateral and coordinated merger effects. 🗣 The workshop featured break-out sessions on these themes, moderated by DG COMP's Terézia Kianičková and Marion Bailly. 💬 Participants took part in interactive discussions facilitated by DG COMP's Andreas Sowa, showcasing the evolving nature of competition policy in response to changing markets and business environments 🌐 The ICN continues to be instrumental in setting global standards and promoting cooperation among competition agencies. #EUCompetition #ICNMergerWorkshop2024

    🔴 The European Commission is carrying out unannounced inspections at companies active in the data centre construction sector, suspecting violations of EU antitrust rules 👇 🔍 The focus is on potential collusive practices, specifically no-poach agreements that restrict employee movement, which may breach EU laws against cartels and anti-competitive agreements. ℹ These inspections are part of preliminary steps to assess whether antitrust violations have occurred. 🤝 The Commission's leniency programme allows companies engaged in secret cartels to receive immunity or significant fine reductions in exchange for self-reporting and cooperating with the Commission.     🔴 The European Commission approves €790 million Romanian State aid measure to support closure of coal mines in Jiu Valley 👇 📩 Romania notified the Commission of a €790 million measure to grant aid to cover exceptional costs arising from the closure of the four uncompetitive coal mines of Lonea, Lupeni, Livezeni and Vulcan. 🌲 The measure will help Romania phase out coal by 2032, following its binding commitment under its National Recovery and Resilience Plan and Territorial Just Transition Plan. The measure covers ⬇ 👷♀️ Social costs for workers who have lost, or will lose, their jobs due to the closure of the mines; 🚧 Expenses related to the safety and remediation works necessary for the closure of the four mines.
