FAIR Canada supports the Canadian Investment Regulatory Organization’s (CIRO) proposal to compensate investors due to misconduct. While the proposal will help, a real game changer would be for CIRO to require its members to comply with the Ombudsman for Banking Services and Investments’ (OBSI) compensation decisions. The Canadian Securities Administrators plans are continuing their work on making OBSI decisions binding. The coalition of consumer advocates continues to support their work—we need a system that truly works for investors. Calculating fair compensation for investors put into unsuitable products is not always clear-cut, particularly where there is no active market for those products. Through consultations with investment dealers and public stakeholders, OBSI developed what experts consider a robust, transparent, and fair method of calculating that amount. We applaud the Ontario Securities Commission and the Canadian Investment Regulatory Organization for undertaking a joint review of sales practices at bank branches. In 2017, FAIR Canada raised serious concerns that bank branch “advisors” focused more on selling products than giving advice. Many financial advisors are licensed salespeople pushing products to meet their sales targets and the banks’ compensation incentive programs. Canadians expect to receive and believe they are receiving advice from banks that is in their best interest.
