The Ontario government recently made changes to the #ExcessSoils regulation (O. Reg 406/19), which are set to take effect on January 1, 2025. These changes positively encourage further reuse of excess soils and reduce regulatory burdens. Some changes include: [check mark] Allowing soil reuse between similar infrastructure projects [check mark] In-situ sampling for stormwater sediment [check mark] Exemptions for soil depots engineering aggregate products for roads Restrictions on landfilling excess soils have been delayed until January 2027. Through OSWCA's advocacy efforts, the recent Construction Act amendments introduce mandatory annual holdback release for all contracts. Owners must now release all accrued holdbacks on the anniversary of the contract, ensuring timely payments and addressing industry concerns about prolonged payment delays. With new lien expiry provisions and a one-year transition period, stakeholders must adjust processes to comply with these critical changes.
