In Centurion Apartment Properties Limited Partnership v Sorensen Trilogy Engineering Ltd., 2024 BCCA 25 (“Centurion”), the British Columbia Court of Appeal ruled that an owner could pursue a negligence claim against an engineer, even without a direct contractual relationship between them. The Court found that despite the “contractual matrix” not directly linking Sorensen (the engineer) and the building owner, Sorensen still had a duty to the owner to exercise reasonable care in creating a design free from dangerous defects. Later, the Supreme Court of Canada denied leave to appeal this decision. The Court of King’s Bench of Alberta introduced a new adjudication process called a “Streamlined Trial” and announced the new Streamlined Trial process in the December 22, 2023, Notice to the Profession and Public. In this Notice to the Profession and Public, the Court set out the requirements for a Streamlined Trial, how the process works, and the guidelines for scheduling and preparing for a Streamlined Trial. Effective as of January 1, 2024, amendments to the Alberta Rules of Court were made regarding the Streamlined Trial process. A Streamlined Trial is a full trial on the merits. With the Supreme Court of Canada granting leave to appeal in Markowich v. Lundin Mining Corporation (Markowich) and several interveners filing, Markowich is sure to appear on the showbills of those watching the operation of Canada’s capital markets. Markowich was one of two recent companion decisions from the Ontario Court of Appeal that attempted to bring clarity to secondary market misrepresentation legislation (the other case being Peters v. SNC-Lavalin Group Inc. (Peters)). These companion cases provide guidance on what constitutes a “material change” under securities legislation.
