Our partner Raphael Zingg discusses a recent decision by the Unified Patent Court’s Munich Local Division prohibiting Scandit from selling its software development kit in a commentary in Managing IP. In short summary: - Scandit's SDK is used by some of the world's largest retailers to build customized barcode scanning apps - Patent owner Honeywell sued for both direct and indirect patent infringement (providing software that is suitable and intended for patent-infringing devices) - The UPC clarified that with the SDK, Scandit only delivers an essential means for implementing the invention (indirect infringemement), but the customers must provide the hardware, barcodes and develop the operating system (direct infringement) - In tailoring the injunction, the UPC considered an absolute prohibition of sales required, and the SDK has to be modified - respectively, the disputed function uninstalled from the library - before further sale.

Rudolf A. Rentsch has been honoured with the Practitioner of the Year award at the Managing IP ceremony in London. IPrime had been shortlisted for Patent Disputes, Patent Prosecution, Practitioner of the Year and Rising Star of the Year. Patent litigation led for our client myStromer before the UPC won the Europe Impact Case award, bestowed to our colleagues at HOYNG ROKH MONEGIER.
