🔍 Online marketplaces under DSA: New rules, new responsibility European digital market regulation is tightening. The Digital Services Act (DSA) has introduced new obligations for online platforms with effect from February 2024, including stricter rules for removing illegal content and greater transparency. The DSA aims to set clear behavioural boundaries for online marketplaces, ensuring that consumers are better protected and that business practices in the digital market are fairer. 📢 Landmark GDPR Ruling by German Federal Court of Justice (VI ZR 10/24) 🇩🇪⚖️ Towards the end of 2024, the German Federal Court of Justice issued a landmark decision (VI ZR 10/24) clarifying claims for non-material damages under Art. 82 #GDPR. The decision confirms that a mere loss of control over #personaldata — without evidence of misuse — can be enough to claim compensation 💰. This strengthens the position of data subjects seeking damages for GDPR breaches. The #BGH follows #ECJ case law, reaffirming that non-material damages under the GDPR do not require direct data misuse — a simple loss of control is sufficient to establish harm. In the #Facebook scraping incident, the BGH suggested EUR 100 as appropriate compensation for data subjects experiencing a mere loss of control over their data. If a claimant argues that their psychological harm exceeds the inconvenience directly linked to this loss, the court of first instance may assess their case and determine whether a higher compensation amount is warranted. The BGH decision brings much-needed clarity and predictability to #GDPR-related claims in #Germany. However, the relatively low suggested compensation may discourage individual claims, reinforcing the need for collective redress mechanisms and #litigationfunding to ensure effective enforcement of GDPR rights. Looking ahead, we can expect: 📌 A rise in group litigation for GDPR violations. 📌 Further clarification from EU courts on how damages should be quantified. ⚖️ Another victory in the Art Recovery Case! ✌ In a major legal victory for our client, Uthman Khatib, the Tribunal Judiciaire de Paris has ruled that 135 Russian avant-garde paintings—worth over €200 million—seized by French authorities include works Mr. Khatib is seeking to recover in German litigation against Mozes Frisch. 🇫🇷 This ongoing high-profile case, funded by LitFin - Litigation Financiers and led by Dentons in Deutschland, involves an international battle over hundreds of paintings that were allegedly stolen by Mr. Frisch. 🖼️ The Paris court’s key findings: ✅ Mr. Khatib has a valid claim over artworks allegedly appropriated by Mr. Frisch. ✅ The court questioned Ms. Amar’s ownership claim, given her silence during the German criminal investigation. ✅ Evidence suggests the provenance of the paintings was falsified. The case continues and the seized paintings will remain in the custody of a Paris court bailiff while the Frankfurt courts rule on the fate of hundreds more.
