This innovative idea took light in December 2021, when our friend and lawyer, Juan Manuel de Faramiñán, invited us to present at the VII INTERNATIONAL COLLOQUIUM OF THE LATIN AMERICAN AND CARIBBEAN SPACE NETWORK - 𝗥𝗲𝗟𝗮𝗖𝗮 𝗘𝗦𝗣𝗔𝗖𝗜𝗢: The focus? The development of 𝗻𝗲𝘄 𝗽𝘂𝗯𝗹𝗶𝗰 𝗽𝗼𝗹𝗶𝗰𝗶𝗲𝘀 for 𝗴𝗲𝗼𝗹𝗼𝗰𝗮𝘁𝗶𝗻𝗴 𝗲𝗺𝗽𝘁𝘆 𝗵𝗼𝗺𝗲𝘀 𝘃𝗶𝗮 𝘀𝗮𝘁𝗲𝗹𝗹𝗶𝘁𝗲 is a bold and exciting opportunity. Unfortunately, due to limited resources, we couldn’t participate. However, this opportunity highlighted would be the next research paper. 𝗧𝗵𝗲 𝗖𝗵𝗮𝗹𝗹𝗲𝗻𝗴𝗲 𝗮𝘁 𝗛𝗮𝗻𝗱 There are over 𝟭𝟬𝟬 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 𝗲𝗺𝗽𝘁𝘆 𝗵𝗼𝗺𝗲𝘀 𝘄𝗼𝗿𝗹𝗱𝘄𝗶𝗱𝗲. To address this, we need innovative policies that prioritize reuse and sustainability with these innovative remote sensing tools. Here’s what EHC envisions for the new policies: 🌱 𝗘𝗻𝘃𝗶𝗿𝗼𝗻𝗺𝗲𝗻𝘁𝗮𝗹 𝗜𝗺𝗽𝗮𝗰𝘁 • Implement new regulations for the prevention of 𝗖𝗢𝟮 𝗲𝗺𝗶𝘀𝘀𝗶𝗼𝗻𝘀, in the carbon market, which not only impact the reuse of empty homes, but also to many other areas such as regenerative agriculture. 💸 𝗘𝗰𝗼𝗻𝗼𝗺𝗶𝗰 𝗜𝗺𝗽𝗮𝗰𝘁 • Transform unused properties into 𝗽𝗿𝗼𝗳𝗶𝘁𝗮𝗯𝗹𝗲, 𝗺𝗮𝗶𝗻𝘁𝗮𝗶𝗻𝗲𝗱 𝗵𝗲𝗿𝗶𝘁𝗮𝗴𝗲 𝗮𝘀𝘀𝗲𝘁𝘀 that benefit communities. The result? Enable a 𝘄𝗶𝗻-𝘄𝗶𝗻-𝘄𝗶𝗻 solution for people, the planet, and economic growth, from regenerative economy. A Collaborative law pilot project to reuse millions empty homes for millions refugees . An MVP , develop by a Camel Start up, dreaming long term and big picture to be part of the solution for a better world , impacting in climate action to prevent and avoid climate disaster . MJA LAB is the Justice Restorative justice lab , where a social profit enterprise ( MJASL ) collaborate in a systemic model , with Arteale Foundation and Artealen Lagunak assotiation , to increase awarness of Empty homes as tipping point to many systemics changes , needed in this extraodinary times. Our dream is collaborate as B2B with a housing global platform to share our MVP , after 12 collaboratives law pilot projects and huge learning experience . This is a regenerative Economy project with impact: PEOPLE (Refugees), PLANET (-10 tonnes of solid waste and - 40 tonnes of CO2 per house re-used instead of building a new one 90 m2 ) and PROFIT (in line with SDGs). Personal contact with Kilmann was initiated through LinkedIn, due to a conflict with their platform that we were unaware of. We made a mistake in the way we purchased the TKI. We wanted to ask for his help in translating TKI into Ukrainian. Logically, the first thing he wanted to do was to solve and clarify the existing conflict. That gave us the opportunity to get to know each other. Everything happens for a reason and his support has been key both professionally and personally. Maria Jose is eternally grateful to Ralph. But reality is more nuanced: • Many homeowners face financial and emotional risks when renting out their properties. • They, too, are often victims of a legal system that fails to support effective collaboration. As a result, millions of homes remain vacant, while millions struggle to find a place to live. This isn’t about blame; it’s about finding solutions that work for everyone. ✨ 𝗕𝗿𝗶𝗻𝗴𝗶𝗻𝗴 𝗘𝗺𝗽𝘁𝘆 𝗛𝗼𝗺𝗲𝘀 𝗕𝗮𝗰𝗸 𝘁𝗼 𝗟𝗶𝗳𝗲: 𝗔 𝗦𝘂𝘀𝘁𝗮𝗶𝗻𝗮𝗯𝗹𝗲 𝗦𝗼𝗹𝘂𝘁𝗶𝗼𝗻 𝗳𝗼𝗿 𝗔𝗹𝗹 🏡 Have you ever heard of the donation of temporary right of use (known in the EU as usufruct)? This innovative approach, championed by EHC, opens the doors of empty homes to those in need while driving sustainable solutions. We’re thrilled to share that we are currently working on a research paper exploring 𝘁𝗮𝘅 𝗶𝗻𝗰𝗲𝗻𝘁𝗶𝘃𝗲𝘀 for reusing empty homes, set to be published next year. This second EHC paper, focused on 𝗰𝗹𝗶𝗺𝗮𝘁𝗲 𝗮𝗰𝘁𝗶𝗼𝗻, aims to identify tax-efficient solutions to expand the global reuse of empty homes. With EHC’s innovative model, it’s possible to provide shelter in less than three months, at minimal cost, making it one of the most planet-friendly approaches available. With the help of EHC project refugees, we’re also demonstrating how a 60-year-old house, never before renovated, can be rehabilitated for under €15,000. 𝗪𝗵𝘆 𝗶𝘀 𝗖𝗼𝗹𝗹𝗮𝗯𝗼𝗿𝗮𝘁𝗶𝘃𝗲 𝗟𝗮𝘄 𝗖𝗲𝗻𝘁𝗿𝗮𝗹 𝘁𝗼 𝗠𝗮𝗿𝗶𝗮 𝗝𝗼𝘀𝗲 𝗔𝗻𝗶𝘁𝘂𝗮'𝘀 𝗟𝗶𝗳𝗲 𝗣𝘂𝗿𝗽𝗼𝘀𝗲 𝗮𝗻𝗱 𝗘𝗛𝗖'𝘀 𝗠𝗶𝘀𝘀𝗶𝗼𝗻? At Maria Jose's core lies a deep connection to the human side of law, a perspective that has shaped her career and personal journey profoundly. This vision was first inspired by her first mentor, Fernando Buesa, a precursor in her intuition of collaborative law whom she worked for in 1981 shortly after completing law school. Fernando was tragically assassinated by ETA over 20 years ago. It is a moving reflection on the profound impact he had on her life and career. During her early years as a lawyer, Maria Jose realized that the adversarial nature of traditional litigation was misaligned with her values. The harshness and hostility of the judicial system weighed heavily on her. She sought a more constructive path, one rooted in collaboration and understanding. The decision to pursue a master’s degree in legal advice for businesses at the IE Business School in Madrid was pivotal. To fund her studies, MJ balanced her academic pursuits with working part-time alongside Fernando. Fortunately, a scholarship made this milestone possible, yet it was not without hardship. Personal tragedy further fueled her determination to find a more human approach to law. Her father’s prolonged litigation against the City Council and a neighboring establishment lasted over a decade, taking a severe toll on his health. His untimely passing at just 55, led by a brain tumor, left Maria Jose, the eldest of six children, with a deep resolve to move away from the destructive nature of traditional litigation. It wasn’t until the age of 52 that Maria Jose discovered collaborative law, a revelation that transformed her life from 2012 onward. This approach aligned with her values, offering a way to resolve conflicts without the violence that had marked her earlier legal experiences. The lessons she learned from Fernando Buesa remain a guiding light in both her personal and professional endeavors at EHC. His teachings continue to resonate, serving as a foundation for the collaborative approach that defines MJA's work today. 🌟 𝗗𝗼 𝘆𝗼𝘂 𝗸𝗻𝗼𝘄 𝘄𝗵𝗮𝘁 𝗮 𝘀𝗮𝗻𝗱𝗯𝗼𝘅 𝗶𝘀? 🌟 The Arteale Foundation has been one without knowing it at the time it was constituted, in 2017, led by two collaborative lawyers seeking Restorative Justice for the 21st century. But what a journey it has been since then! Over the years, Arteale has spearheaded 𝟭𝟭 𝗽𝗶𝗹𝗼𝘁 𝗽𝗿𝗼𝗷𝗲𝗰𝘁𝘀 aimed at driving systemic legal change through 𝗖𝗼𝗹𝗹𝗮𝗯𝗼𝗿𝗮𝘁𝗶𝘃𝗲 𝗟𝗮𝘄. With little success, but each "failure" taught us invaluable lessons. Those lessons paved the way for the development of EHC. This insight could hopefully open a new space in the carbon market centered on prevention, not just compensation. Experts in the field with whom we are collaborating have affirmed this perspective. Here's why this matters: every time we build a new home while existing ones sit empty, we generate a massive carbon footprint. Construction produces significant greenhouse gases and waste, accelerating climate change. In a world increasingly battered by climate disasters (think of the hurricanes in Florida, or the flooding in Brazil, North Carolina, and Spain) we urgently need to rethink how we take action. 𝗧𝗵𝗲 𝗧𝗶𝗺𝗲 𝘁𝗼 𝗔𝗰𝘁 𝗜𝘀 𝗡𝗼𝘄. Systemic change often starts with community-driven solutions. Waiting until climate disasters reach our doorstep isn't a strategy we can afford. Recent data from Zurich (October 23, 2024) reveals a stark reality: • 𝟮𝟭.𝟱 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 𝗽𝗲𝗼𝗽𝗹𝗲 were displaced annually between 2008 and 2016 due to extreme weather and environmental changes. • By 2022, that number surged to 𝟯𝟮.𝟲 𝗺𝗶𝗹𝗹𝗶𝗼𝗻. • Without action, experts warn 𝟭.𝟮 𝗯𝗶𝗹𝗹𝗶𝗼𝗻 𝗽𝗲𝗼𝗽𝗹𝗲 could face displacement by 2050. 𝗔 𝗖𝗮𝗹𝗹 𝗳𝗼𝗿 𝗝𝘂𝘀𝘁𝗶𝗰𝗲 As researchers in restorative justice, we advocate for the legal recognition of climate refugees as asylum seekers. Their suffering is often comparable to, or worse than, that endured by victims of war or persecution. 𝗪𝗵𝘆 𝗔𝗰𝘁𝗶𝗼𝗻 𝗶𝘀 𝗘𝘀𝘀𝗲𝗻𝘁𝗶𝗮𝗹 Addressing this challenge requires urgent, collective action: • Support Vulnerable Populations: Ensure that those at risk have the resources and protection they need. • Mitigate Climate Change: Reduce greenhouse gas emissions to prevent further displacement. • Advocate for Policies: Push for legal frameworks that protect and support climate refugees. If we act now, we can lessen the impact on millions of lives.
