🌟 ELSA IE Shines at the National Council Meeting in Madrid! 🌟 This past month, several of our dedicated board members had the honor of attending the National Council Meeting in Madrid, joining forces with ELSA chapters from all across Spain. At ELSA IE, we take immense pride in contributing to the broader mission of ELSA Spain. This meeting was particularly significant for us as our President, Jade Toledano played a pivotal role by leading the event as Secretary General of ELSA Spain. Adding to the celebration, our very own Lucas Huerta-Murillo Grau was officially ratified as Vice President of Competitions for ELSA Spain—a testament to his hard work and commitment! We are deeply grateful to our representatives— Louis Alexander Schmitz, Cristian Munteanu, Sherlyn Puma-Duran, and Maksim Kudinov —for showcasing the incredible work and dedication of ELSA IE. Their participation reflects our unwavering commitment not only to the IE University community but also to the continued growth and success of ELSA Spain. Here’s to continued collaboration, excellence, and the shared pursuit of ELSA’s mission! 🌍💼 #IEUniversity #ELSAIE #Collaboration #Lawyers #ELSASpain

On behalf of ELSA IE, it is our absolute pleasure to congratulate our current ELSA IE President, Jade Toledano, on starting her new position as the ELSA Spain Secretary General, as of yesterday August 1st, 2024. Ms. Toledano was elected last April at the ELSA Spain National Council Meeting, hosted in Barcelona this past Spring. She will serve concurrently in both roles for the upcoming term, dedicating her time, commitment, and efforts to pushing ELSA IE and ELSA Spain to newer heights. This new chapter highlights her unwavering commitment to the values and goals of ELSA— we are very proud of Ms. Toledano and wish her a productive and successful term on the ELSA Spain Board of Directors, and wishing her the best as she leads our association this coming term.

🐘 The ELSA IE University EU Law conference: the elephants in the DMA room. What's the current configuration of the regulatory instrument? What is the economic background of the DMA? What effects does the regulation entail for businesses, in practice? These three key questions loomed over today's conference disentangling the legal, economic and practical balances stricken by the regulation. For the first panel, I was well surrounded by Katarzyna Sadrak and Pablo Velasco Sanzo to explain the legal basis of the DMA (alas, harmonisation), some of the substantive impacts of the regulation as well as the interplay between the DMA and other pieces of EU law, notably the GDPR and the concepts of consent and anonymised data. It was a nuanced discussion that Pablo Solano Díaz moderated with courage, albeit critical voices to the DMA such as Carolina Fernández Bustillo who rightly voiced the need to better communicate what the DMA is despite its 'strange' nature. As a key takeaway, I would point out the DMA's character as a third-way solution: not antitrust nor completely liberalisation-targeted. In that sense, it can be understood both as non-confrontational regulation and as a framework providing an adequate (?) punitive toolbox to the EC. Thanks to ELSA, Maksim for organising everything so perfectly well and Pablo for his invitation to participate in the panel.

🤺 The Digital Services Act package under the spotlight - the keys to effective compliance, the justification of regulatory intervention and the DMA's broader objectives. 🔜 Next Thursday, ELSA IE University will hold its European Union Law Conference at IE Law School. During an intense day, the conference meanders into the intricacies of both the DMA and the DSA at large to explore the legal balances stricken in the DMA and the DSA, the economic aspects of digital platforms and the challenges companies face in their implementation. On the note of my participation, I will contribute to the first panel to be held at 10 am, where we will discuss the Commission's current enforcement strategy in the DMA's interpretation and the gatekeeper's reactions to the compliance deadline. Pablo Solano Díaz moderates the first panel, and Pablo Velasco Sanzo and Katarzyna Sadrak will engage in the topical discussion. A panel dominated by officials from competition authorities, where I will pitch in with academic flair. Let's hope no network effects or switching costs turn against me, and the multi-homing of ideas crosscuts the discussion. The two remaining panels for the day bring together a great line-up of speakers coming from different backgrounds. I invite you all to join us by registering for the event (you'll find the details in the image below). P.S. A great shout-out goes to Maksim Kudinov for making (most of) it happen!
