Form of order sought

principally, a declaration that, by failing to adopt all the laws, regulations and administrative provisions necessary to comply with Directive 2004/28/EC (1) of the European Parliament and of the Council of 31 March 2004 amending Directive 2001/82/EC on the Community code relating to veterinary medicinal products, the Portuguese Republic has failed to fulfil its obligations under Article 3 of that directive;

in the alternative, a declaration that, by failing in any event to communicate such provisions to the Commission, the Portuguese Republic has failed to fulfil its obligations under that article of the directive;

an order for the Portuguese Republic to pay the costs.

Pleas in law and main arguments

The period prescribed for transposition of the directive into domestic law expired on 30 October 2005.
