No 106/2000

of 30 November 2000

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as adjusted by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 78/2000 of the EEA Joint Committee of 2 October 2000(1).

(2) Commission Directive 94/69/EC of 19 December 1994 adapting to technical progress for the 21st time Council Directive 67/548/EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances(2) is to be incorporated into the Agreement.

(3) Commission Directive 96/54/EC of 30 July 1996 adapting to technical progress for the 22nd time Council Directive 67/548/EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances(3) is to be incorporated into the Agreement.

(4) Commission Directive 97/69/EC of 5 December 1997 adapting to technical progress for the 23rd time Council Directive 67/548/EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XV of Annex II to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Directives 94/69/EC, 96/54/EC and 97/69/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 1 December 2000, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.

ANNEX

to Decision No 106/2000 of the EEA Joint Committee

The following shall be added in point 1 (Council Directive 67/548/EEC) of Chapter XV of Annex II to the Agreement: "- 394 L 0069: Commission Directive 94/69/EC of 19 December 1994 (OJ L 381, 31.12.1994, p. 1),

- 396 L 0054: Commission Directive 96/54/EC of 30 July 1996 (OJ L 248, 30.9.1996, p. 1),

- 397 L 0069: Commission Directive 97/69/EC of 5 December 1997 (OJ L 343, 13.12.1997, p. 19).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptations:

Annex I, table B to Council Directive 67/548/EEC shall be supplemented with the texts as set out below:
