amending Regulation (EU) No 692/2014 concerning restrictive measures in response to the illegal annexation of Crimea and Sevastopol


EXPLANATORY MEMORANDUM

(1)Council Regulation (EU) No 692/2014 concerning restrictive measures in response to the illegal annexation of Crimea and Sevastopol gives effect to restrictive measures provided for in Council Decision 2014/386/CFSP.

(2)In order to ensure uniform conditions for the implementation of Council Regulation (EU) No 692/2014, a provision should be added to empower the Commission to amend the Annex containing the contact details of Member States’ competent authorities and the address for notifications to the Commission.

(3)Annex I of Council Regulation (EU) No 692/2014 should be replaced.

(4)These amendments fall within the scope of the Treaty and therefore regulatory action at the Union level is necessary in order to implement them, in particular with a view to ensure uniform application in all Member States.

(5)The High Representative of the Union for Foreign Affairs and Security Policy and the Commission propose to amend Regulation (EU) No 692/2014 accordingly.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215 thereof,

Having regard to Council Decision 2014/386/CFSP of 23 June 2014 concerning restrictive measures in response to the illegal annexation of Crimea and Sevastopol 1 ,

Having regard to the joint proposal from the High Representative of the Union for Foreign Affairs and Security Policy and of the European Commission,

Whereas:

(1)On 23 June 2014, the Council adopted Decision 2014/386/CFSP and Regulation (EU) No 692/2014 2 , concerning restrictive measures in response to the illegal annexation of Crimea and Sevastopol.

(2)In order to ensure uniform conditions for the implementation of Council Regulation (EU) No 692/2014, the Commission should be empowered to amend the Annex containing the contact details of Member States’ competent authorities and the address for notifications to the Commission.

(3)Annex I of Council Regulation (EU) No 692/2014 should also be replaced.

(4)These amendments fall within the scope of the Treaty and therefore regulatory action at the level of the Union is necessary in order to implement them, in particular with a view to ensure uniform application in all Member States.

(5)Council Regulation (EU) No 692/2014 should therefore be amended accordingly.

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EU) No 692/2014 is amended as follows:

(1)in Article 1, point (e), ‘the Annex’ is replaced by ‘Annex I’;

(2)in paragraphs 1 and 3 of Article 9, ‘the Annex’ is replaced by ‘Annex I’;

(3)in Article 9, the following point is added:

‘4. The Commission shall be empowered to amend Annex I on the basis of information supplied by Member States.’

(4)Annex I is replaced by the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
