amending Annexes II, III and V to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for 2,5-dichlorobenzoic acid methylester, mandipropamid and profoxydim in or on certain products

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (1), and in particular Article 14(1)(a), Article 18(1)(b) and Article 49(2) thereof,
Whereas:

For mandipropamid and profoxydim maximum residue levels (MRLs) were set in Part A of Annex III to Regulation (EC) No 396/2005. For 2,5-dichlorobenzoic acid methylester no MRLs are set in Regulation (EC) No 396/2005, and as this active substance is not included in Annex IV to that Regulation, the default value of 0,01 mg/kg laid down in Article 18(1)(b) of that Regulation applies. |

For 2,5-dichlorobenzoic acid methylester, the European Food Safety Authority (‘the Authority’) submitted a reasoned opinion on the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (2). The Authority concluded that residues of 2,5-dichlorobenzoic acid methylester are not expected to occur in any plant or animal commodities since its unique and restricted use as a pesticide in wine grapes after grafting is not expected to result in significant residues in wine grapes. It is therefore appropriate to set the MRLs at the specific limit of determination. These default values should be set in Annex V to Regulation (EC) No 396/2005. |

For mandipropamid, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (3). The Authority proposed to change the residue definition to mandipropamid (any ratio of constituent isomers). It recommended raising or keeping the existing MRLs. It concluded that concerning the MRLs for potatoes, onions, spring onions/green onions and Welsh onions, tomatoes and courgettes, some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, the MRLs for those products should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. These MRLs will be reviewed; the review will take into account the information available within two years from the publication of this Regulation. |

For profoxydim, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (4). It recommended keeping the existing MRLs. |

As regards products on which the use of the plant protection products concerned is not authorised, and for which no import tolerances or CXLs exist, MRLs should be set at the specific limit of determination or the default MRL should apply, as provided for in Article 18(1)(b) of Regulation (EC) No 396/2005. |
(6) |
The Commission consulted the European Union reference laboratories for residues of pesticides as regards the need to adapt certain limits of determination. As regards several substances, those laboratories concluded that for certain commodities technical development requires the setting of specific limits of determination. |
(7) |
Based on the reasoned opinions of the Authority and taking into account the factors relevant to the matter under consideration, the appropriate modifications to the MRLs fulfil the requirements of Article 14(2) of Regulation (EC) No 396/2005. |
(8) |
Through the World Trade Organisation, the trading partners of the Union were consulted on the new MRLs and their comments have been taken into account. |
(9) |
Regulation (EC) No 396/2005 should therefore be amended accordingly. |
(10) |
In order to allow for the normal marketing, processing and consumption of products, this Regulation should provide for a transitional arrangement for products which have been produced before the modification of the MRLs and for which information shows that a high level of consumer protection is maintained. |
(11) |
A reasonable period should be allowed to elapse before the modified MRLs become applicable in order to permit Member States, third countries and food business operators to prepare themselves to meet the new requirements which will result from the modification of the MRLs. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annexes II, III and V to Regulation (EC) No 396/2005 are amended in accordance with the Annex to this Regulation.
Article 2
Regulation (EC) No 396/2005 as it stood before being amended by this Regulation shall continue to apply to products which were produced in the Union or imported into the Union before 31 January 2020.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
It shall apply from 31 January 2020.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EU) No 142/2011 as regards imports of gelatine, flavouring innards and rendered fats

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1069/2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (1), and in particular Article 29(4) and Article 41(4), thereof,
Whereas:

Commission Regulation (EU) No 142/2011 (2) lays down public and animal health conditions for imports of gelatine, flavouring innards and rendered fats. |
(2) |
Table 1 of Section 1 of Chapter I and Table 2 of Section 1 of Chapter II of Annex XIV to Regulation (EU) No 142/2011 set out requirements for imports into the Union of animal by-products. |
(3) |
Egypt provided the Commission with sufficient guarantees for the controls by the competent authority on the production of gelatine. It is therefore justified to add Egypt to the list of third countries from where gelatine may be imported into the Union. |
(4) |
Flavouring innards for the manufacture of pet food may be obtained from domestic but also from wild animals slaughtered or killed for human consumption. It is opportune to align the list of third countries eligible for the import of flavouring innards with a reference to the list of third countries authorised for the imports of wild game meat for human consumption. |
(5) |
Commission Regulation (EU) 2017/1261 (3) introduced an alternative method, based on EFSA assessment (4), for the production of renewable fuels. It is opportune to allow imports of rendered fats referred to in Articles 8, 9 and 10 of Regulation (EC) No 1069/2009 for the use in the new alternative method since the use of the same materials is allowed in the Union. Chapter II of Annex XIV to Regulation (EU) No 142/2011 should be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex XIV to Regulation (EU) No 142/2011 is amended in accordance with the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

on the position to be taken on behalf of the European Union within the Cooperation Committee set up by the Agreement on Cooperation and Customs Union betwee the European Community and its Member States, of the one part, and the Republic of San Marino, of the other part with regard to applicable provisions on organic production and labelling of organic products, and arrangements for imports of organic products
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 43, in conjunction with Article 218(9) thereof,
Having regard to the proposal from the European Commission,
Whereas:

The Agreement on Cooperation and Customs Union between the European Community and its Member States, of the one part, and the Republic of San Marino, of the other part (1) (the ‘Agreement’) was concluded by the Union by Council Decision 2002/245/EC (2) and entered into force on 1 April 2002. |
(2) |
Pursuant to Article 7(2) of the Agreement, the Cooperation Committee is to determine in greater detail the provisions of Union legislation to be applied, in respect of countries not members of the Union, inter alia, in the field of Union veterinary, plant health and quality regulations where necessary for the proper functioning of the Agreement. |
(3) |
The Cooperation Committee is to adopt a decision on the applicable provisions, under the Agreement, of Union legislation on organic production and labelling of organic products, and arrangements for imports of organic products. |
(4) |
It is appropriate to establish the position to be taken on the Union's behalf in the Cooperation Committee, as the determination in greater detail of the applicable provisions of Union legislation will enhance legal certainty among the parties to the Agreement and will support the proper functioning of the customs union between the Union and San Marino. |
(5) |
Consequently, there is a need to clarify the applicable Union legislation on organic production and labelling of organic products, which includes Council Regulation (EC) No 834/2007 (3) and Commission Regulations (EC) No 889/2008 (4) and (EC) No 1235/2008 (5). In addition, it is appropriate to lay down the necessary arrangements for imports of organic products, as well as a procedure to be followed in the event that new Union legislation on organic production and labelling of organic products is adopted that affects the references to the applicable provisions and the arrangements agreed. |
(6) |
The position of the Union within the Cooperation Committee should therefore be based on the attached draft Decision, |
HAS ADOPTED THIS DECISION:
Article 1
The position to be taken on the Union's behalf within the Cooperation Committee set up by the Agreement on Cooperation and Customs Union between the European Community and its Member States, of the one part, and the Republic of San Marino, of the other part shall be based on the draft decision of the Cooperation Committee attached to this Decision.
Minor changes to the draft decision referred to in the first paragraph may be agreed to by the representatives of the Union within the Cooperation Committee without further Decision of the Council.
Article 2
This Decision shall enter into force on the date of its adoption.

THE EU–SAN MARINO COOPERATION COMMITTEE,
Having regard to the Agreement on Cooperation and Customs Union between the European Community and its Member States, of the one part, and the Republic of San Marino, of the other part (1), and in particular Articles 7(2), 8(3) c) and 23(1) thereof,
Whereas:

Article 6(4) of the Agreement on Cooperation and Customs Union between the European Community and its Member States, of the one part, and the Republic of San Marino, of the other part (‘the Agreement’) provides that, in trade in agricultural products between the Union and the Republic of San Marino, the Republic of San Marino undertakes to adopt Union quality legislation where necessary for the proper functioning of the Agreement. |
(2) |
Under the fifth indent of Article 7(1) of the Agreement, the Republic of San Marino is to apply, in respect of countries not members of the Union (‘third countries’), the Union quality legislation where necessary for the proper functioning of the Agreement. |
(3) |
In order to avoid obstacles to the free circulation of the goods and to ensure the proper functioning of the customs union established by the Agreement, it is appropriate to determine in greater detail the provisions of Union quality legislation applicable to organic production and labelling of organic products. |
(4) |
In order to ensure compliance with Union legislation in relation to imports of organic products from third countries into the Republic of San Marino, it is necessary to lay down the relevant arrangements to be applied by its national authorities. |
(5) |
In order to ensure compliance with Union legislation in relation to organic products prepared or produced in the Republic of San Marino, the relevant arrangements should also be laid down. |
(6) |
It is also appropriate to provide for a procedure to be followed in the event that new Union legislation on organic production and labelling of organic products is adopted that affects the references to the provisions and the arrangements laid down in this Decision, |
HAS ADOPTED THIS DECISION:
Article 1
The applicable provisions of Union legislation on organic production and labelling of organic products are listed in Annex A.
Article 2
Arrangements necessary to ensure compliance with the Union legislation referred to in Article 1 in relation to imports of organic products from third countries into the Republic of San Marino are laid down in Annex B.
Article 3
Arrangements necessary to ensure compliance with the Union legislation referred to in Article 1 in relation to organic products prepared or produced in the Republic of San Marino are laid down in Annex C.
Article 4
Amendments of Annexes A, B and C as well as other practical arrangements necessary for the application of the legislation referred to in those Annexes shall be agreed by the services of the European Commission and the authorities of the Republic of San Marino.
Article 5
This Decision shall enter into force on the date of its adoption.

Organic products imported into the Republic of San Marino from third countries shall be accompanied by a certificate of inspection as referred in point (d) of the first subparagraph of Article 33(1) of Regulation (EC) No 834/2007. |

The Republic of San Marino shall use the electronic Trade Control and Expert System (TRACES) established by Commission Decision 2003/24/EC (1) to process the electronic certificates of inspection for imports of organic products from third countries. |

For the purposes of Article 13 of Regulation (EC) No 1235/2008, in respect of imports of organic products from third countries into the Republic of San Marino the verification of the consignment and the endorsement of the certificates of inspections using TRACES shall be carried out on behalf of the Republic of San Marino by the customs offices listed in Annex II to Omnibus Decision No 1/2010 (2). |

on guidelines for the employment policies of the Member States
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 148(2) thereof,
Having regard to the proposal from the European Commission,
Having regard to the opinion of the European Parliament (1),
Having regard to the opinion of the European Economic and Social Committee (2),
After consulting the Committee of the Regions,
Having regard to the opinion of the Employment Committee (3),
Whereas:

Member States and the Union are to work towards developing a coordinated strategy for employment and particularly for promoting a skilled, trained and adaptable workforce as well as labour markets that are responsive to economic change, with a view to achieving the objectives of full employment and social progress set out in Article 3 of the Treaty on European Union. |
(2) |
In accordance with the Treaty on the Functioning of the European Union (TFEU), the Union has developed and implemented policy coordination instruments for fiscal, macroeconomic and structural policies. As part of those instruments, the guidelines for the employment policies of the Member States set out in the Annex to Council Decision (EU) 2018/1215 (4) (‘the employment guidelines’) and the broad guidelines for the economic policies of the Member States and of the Union set out in Council Recommendation (EU) 2015/1184 (5) form the integrated guidelines for implementing the Europe 2020 strategy (‘the integrated guidelines’). They are to guide policy implementation in the Member States and in the Union, reflecting the interdependence between the Member States. The resulting set of coordinated Union and national policies and reforms are to constitute an appropriate overall economic and social policy mix that should achieve positive spillover effects. |
(3) |
The European Semester combines different instruments in an overarching framework for integrated multilateral surveillance of economic, budgetary, employment and social policies and aims to achieve the Europe 2020 targets, including those concerning employment, education and poverty reduction, as set out in Council Decision 2010/707/EU (6). While promoting the policy objectives of boosting investments, pursuing structural reforms and ensuring responsible fiscal policies, the European Semester has been continuously reinforced and streamlined since 2015. Its employment and social focus has notably been strengthened; and dialogue with the Member States, the social partners and representatives of civil society has been deepened. |
(4) |
In November 2017 the European Parliament, the Council and the Commission signed an interinstitutional proclamation for a European Pillar of Social Rights, setting out 20 principles and rights to support well-functioning and fair labour markets and welfare systems. The European Pillar of Social Rights constitutes a reference framework to monitor the employment and social performance of Member States, to drive reforms at national level and to serve as a compass for a renewed process of convergence across the Union. |
(5) |
The integrated guidelines should form the basis for country-specific recommendations that the Council may address to the Member States. Member States should make full use of the European Social Fund and other Union funds when implementing the employment guidelines. Although the addressees of the integrated guidelines are the Member States and the Union, the employment guidelines should be implemented in partnership with all national, regional and local authorities, closely involving parliaments, as well as the social partners and representatives of civil society. |
(6) |
The Employment Committee and the Social Protection Committee should monitor how the relevant policies are implemented in light of the employment guidelines, in line with their respective TFEU-based mandates. Those committees and other Council preparatory bodies involved in the coordination of economic and social policies should work together closely. Policy dialogue between the European Parliament, the Council and the Commission should be maintained, in particular as regards the employment guidelines. |
(7) |
The Social Protection Committee has been consulted. |
(8) |
The employment guidelines should remain stable to ensure a focus on their implementation. Following an assessment of developments in the labour markets and the social situation since the adoption of the employment guidelines in 2018, it has been determined that no update is necessary. The reasons for the adoption of the employment guidelines in 2018 remain valid, so those guidelines should be maintained, |
HAS ADOPTED THIS DECISION:
Article 1
The guidelines for the employment policies of the Member States, as set out in the Annex to Decision (EU) 2018/1215, are maintained for 2019 and shall be taken into account by the Member States in their employment policies and reform programmes.
Article 2
This Decision is addressed to the Member States.

The subject matter of the proposed citizens' initiative entitled ‘EU law, minority rights and democratisation of Spanish institutions’ refers to the following: ‘Systemic risks in Spain, the treatment of minority groups and the urgent need to encourage action to help democratise the country and align it with the basic principles of EU law.’ |

The objectives of the proposed citizens' initiative refer to the following: ‘Our aim is to ensure that both the Commission and the Parliament are fully aware of the current situation in Spain, the systemic risks in the country, the failure to comply with the rules and guiding principles of EU law and the need to set mechanisms in motion to help improve democratic standards in Spain, thereby guaranteeing the rights and freedoms of minority groups and of all Spanish citizens by means of EU law and instruments.’ |

The Treaty on European Union (TEU) reinforces citizenship of the Union and enhances further the democratic functioning of the Union by providing, inter alia, that every citizen is to have the right to participate in the democratic life of the Union by way of a European citizens' initiative. |

The subject matter of the proposed citizens' initiative entitled ‘A price for carbon to fight climate change’ refers to the following: ‘We ask the European Commission to propose a EU legislation to discourage the consumption of fossil fuels, encourage energy saving and the use of renewable sources for fighting global warming and limiting temperature increase to 1,5 °C.’ |

The objectives of the proposed citizens' initiative refer to the following: ‘Our proposal introduces a minimum price on CO2 emissions, starting from EUR 50 per CO2 tonne from 2020 up to EUR 100 by 2025. At the same time, the proposal shall abolish the existing system of free allowances to EU polluters and introduce a border adjustment mechanism on non-EU imports, in such a way as to compensate for the lower pricing on CO2 emissions in the exporting country. The higher revenue deriving from carbon pricing shall be allocated to European policies that support energy saving and the use of renewable sources, and to the reduction of taxation on lower incomes.’ |

Our objective is to facilitate the authorization procedure for those products obtained through NPBTs, which carry only natural existing traits. Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary checks applicable in intra-Union trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,
Whereas:

Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine fever in certain Member States, where there have been confirmed cases of that disease in domestic or feral pigs (the Member States concerned). The Annex to that Implementing Decision demarcates and lists certain areas of the Member States concerned in Parts I to IV thereof, differentiated by the level of risk based on the epidemiological situation as regards that disease. The Annex to Implementing Decision 2014/709/EU has been amended several times to take account of changes in the epidemiological situation in the Union as regards African swine fever that need to be reflected in that Annex. The Annex to Implementing Decision 2014/709/EU was last amended by Commission Implementing Decision (EU) 2019/1147 (5), following an instance of African swine fever in both Poland and Romania. |

Since the date of adoption of Implementing Decision (EU) 2019/1147, there have been further instances of African swine fever in domestic and feral pigs in Poland, Bulgaria, Latvia and Lithuania that also need to be reflected in the Annex to Implementing Decision 2014/709/EU. |

In July 2019, a number of cases of African swine fever in feral pigs were observed in the districts of Lidzbark Warmiński, Niemce, Grabów nad Pilicą and Izbica in Poland in close proximity to areas listed in Part I of the Annex to Implementing Decision 2014/709/EU. These cases of African swine fever in feral pigs constitute an increased level of risk which should be reflected in that Annex. Accordingly, these areas of Poland affected by African swine fever should be listed in Part II of the Annex to Implementing Decision 2014/709/EU instead of in Part I thereof. |

In July 2019, one outbreak of African swine fever in domestic pigs was observed in the district of Giżycko in Poland in an area listed in Part II of the Annex to Implementing Decision 2014/709/EU. This outbreak of African swine fever in domestic pigs constitutes an increased level of risk which should be reflected in that Annex. Accordingly, this area of Poland affected by African swine fever should be listed in Part III of the Annex to Implementing Decision 2014/709/EU instead of in Part II thereof. |

This outbreak of African swine fever in domestic pigs constitutes an increased level of risk which should be reflected in that Annex. Accordingly, this area of Lithuania affected by African swine fever should be listed in Part III of the Annex to Implementing Decision 2014/709/EU instead of in Part II thereof. |

In order to take account of recent developments in the epidemiological evolution of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new high-risk areas of a sufficient size should be demarcated for Poland, Bulgaria, Latvia and Lithuania and duly listed in Parts I, II and III of the Annex to Implementing Decision 2014/709/EU. The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. |

DECISION No 1/2019 OF THE EPA COMMITTEE ESTABLISHED BY THE STEPPING STONE ECONOMIC PARTNERSHIP AGREEMENT BETWEEN CÔTE D'IVOIRE, OF THE ONE PART, AND THE EUROPEAN COMMUNITY AND ITS MEMBER STATES, OF THE OTHER PART

concerning the accession of the Republic of Croatia to the European Union [2019/1186]
THE EPA COMMITTEE,
Having regard to the stepping stone Economic Partnership Agreement between Côte d'Ivoire, of the one part, and the European Community and its Member States, of the other part (hereinafter the ‘Agreement’), signed in Abidjan on 26 November 2008, and applied on a provisional basis since 3 September 2016, and in particular Articles 76, 77 and 81 thereof,
Having regard to the Treaty concerning the accession of the Republic of Croatia to the European Union (hereinafter the ‘Union’) and to the Act of Accession to the Agreement deposited by the Republic of Croatia on 8 November 2017,
Whereas:

The Agreement applies, on the one hand, to the territories in which the Treaty on the Functioning of the European Union is applied and under the conditions laid down in that Treaty and, on the other hand, to the territory of Côte d'Ivoire. |
(2) |
Pursuant to Article 77(3) of the Agreement, the EPA Committee may decide on any amending measures which might be necessary following the accession of new Member States to the Union, |
HAS ADOPTED THIS DECISION:
Article 1
The Republic of Croatia, as a Party to the Agreement, shall, in the same manner as the other Member States of the Union, respectively adopt and take note of the text of the Agreement, as well as of the Annexes, Protocols and Declarations attached thereto.
Article 2
Article 81 of the Agreement shall be replaced by the following:

Authentic texts
This Agreement is drawn up in duplicate in the Bulgarian, Croatian, Czech, Danish, Dutch, English, Estonian, Finnish, French, German, Greek, Hungarian, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Romanian, Slovak, Slovenian, Spanish and Swedish languages, each of these texts being equally authentic.’.
Article 3
The Union shall communicate the Croatian language version of the Agreement to Côte d'Ivoire.
Article 4
1. The provisions of the Agreement shall apply to goods exported from either Côte d'Ivoire to the Republic of Croatia or from the Republic of Croatia to Côte d'Ivoire which comply with the rules of origin in force in the territory of the Parties to the Agreement and which, on 3 September 2016, were either in transit or in temporary storage, in a customs warehouse or in a free zone in Côte d'Ivoire or in the Republic of Croatia.
2. Preferential treatment shall be granted in the cases referred to in paragraph 1, provided that a proof of origin issued retroactively by the customs authorities of the exporting country is submitted to the customs authorities of the importing country, within four months of the date of entry into force of this Decision.
Article 5
Côte d'Ivoire undertakes not to make any claim, request or referral nor to modify or withdraw any concession pursuant to Article XXIV.6 and Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 or Article XXI of the General Agreement on Trade in Services (GATS) in relation to the accession of the Republic of Croatia to the Union.
Article 6
This Decision shall enter into force on the date of its signature.
However, Articles 3 and 4 shall apply from 3 September 2016.
