The Commission has decided to close the formal investigation procedure initiated under Article 88(2) of the EC Treaty (which became Article 108(2) TFEU) on 16 July 2008 (1) in respect of the measure referred to above, in view of the fact that Italy withdrew its notification on 30 September 2009.
