establishing the standard import values for determining the entry price of certain fruit and vegetables
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules of Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (1), and in particular Article 138(1) thereof,
Whereas:

(1) |
Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto. |
|
(2) |
In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 shall be fixed as indicated in the Annex hereto.
Article 2
This Regulation shall enter into force on 31 January 2008.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

on special conditions for the granting of private storage aid for sheepmeat and goatmeat
(Codified version)
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 2529/2001 of 19 December 2001 on the common organisation of the market in sheepmeat and goatmeat (1), and in particular Article 12(2) thereof,
Whereas:

(1) |
Commission Regulation (EEC) No 3447/90 of 28 November 1990 on special conditions for the granting of private storage aid for sheepmeat and goatmeat (2) has been substantially amended several times (3). In the interests of clarity and rationality the said Regulation should be codified. |
|
(2) |
The provisions of Commission Regulation (EC) No 6/2008 of 4 January 2008 laying down detailed rules for granting private storage aid for sheepmeat and goatmeat (4), should be followed in respect of the grant of private storage aid for sheepmeat. It is appropriate to complete or to adapt these provisions. |
|
(3) |
It is appropriate that, in addition to the amounts of aid granted for a specific storage period, amounts to be added or reduced in the event of that period being extended or curtailed should also be fixed. |
|
(4) |
Foreseeable market conditions make it necessary to provide for flexible storage periods of between three and seven months. |
|
(5) |
It is appropriate in order to ensure genuine tenders, to determine the minimum quantity which may be stored. It is appropriate to determine the minimum quantity to be destocked. |
|
(6) |
A security should be established to guarantee compliance with the obligations linked to private storage. |
|
(7) |
The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Sheep and Goats, |
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EC) No 6/2008 shall apply subject to the provisions of this Regulation.
Article 2
1. Applications in the context of private storage aid shall be submitted to the intervention agencies listed in Annex I.
2. In the context of a tendering procedure the period for which storage may be tendered is three months. However, the actual storage period shall be chosen by the storer. This period may extend from a minimum of three months to a maximum of seven months. However, if the storage period is greater than three months the aid shall be increased on a daily basis by EUR 1,45 per tonne per day.
Article 3
The minimum quantity per contract shall be four tonnes expressed, as bone-in meat.
Article 4
The minimum quantity for each removal is fixed at four tonnes expressed as product weight per store and per contractor. However, where the quantity left in a store is less than this quantity, one further withdrawal operation of the remaining quantity or part thereof shall be permitted.
Where these withdrawal conditions are not complied with:

the amount of aid for the quantity withdrawn shall be calculated in accordance with Article 6(3) of Regulation (EC) No 6/2008, and |
|
— |
15 % of the security referred to in Article 5 shall be declared forfeit in respect of the quantity withdrawn. |
Article 5
The security shall be EUR 145 per tonne.
Article 6
Regulation (EEC) No 3447/90 is repealed.
References to the repealed Regulation shall be construed as references to this Regulation and shall be read in accordance with the correlation table in Annex III.
Article 7
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EC) No 318/2007 laying down animal health conditions for imports of certain birds into the Community and the quarantine conditions thereof

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 91/496/EEC of 15 July 1991 laying down the principles governing the organisation of veterinary checks on animals entering the Community from third countries and amending Directives 89/662/EEC, 90/425/EEC and 90/675/EEC (1), and in particular the second subparagraph of Article 10(3) and the first subparagraph of Article 10(4) thereof,
Having regard to Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC (2), and in particular the fourth indent of Article 18(1),
Whereas:

Commission Regulation (EC) No 318/2007 (3) lays down the animal health conditions for imports of certain birds other than poultry into the Community and the quarantine conditions applicable to such birds after import. |
|
(2) |
Annex V to Regulation (EC) No 318/2007 sets out a list of quarantine facilities and centres approved by the competent authorities of the Member States for import of certain birds other than poultry. |
|
(3) |
The Czech Republic, Germany and Spain have reviewed their approved quarantine facilities and centres and have sent an updated list of those quarantine facilities and centres to the Commission. The list of approved quarantine facilities and centres set out in Annex V to Regulation (EC) No 318/2007 should therefore be amended accordingly. |
|
(4) |
Regulation (EC) No 318/2007 should therefore be amended accordingly. |
|
(5) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex V to Regulation (EC) No 318/2007 is replaced by the text in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DIRECTIVE 2008/5/EC

concerning the compulsory indication on the labelling of certain foodstuffs of particulars other than those provided for in Directive 2000/13/EC of the European Parliament and of the Council

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Directive 2000/13/EC of the European Parliament and of the Council of 20 March 2000 on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs (1), and in particular Article 4(2) thereof,
Having regard to Directive 94/35/EC of the European Parliament and of the Council of 30 June 1994 on sweeteners for use in foodstuffs (2), and in particular Article 6 thereof,
Whereas:

(1) |
Commission Directive 94/54/EC of 18 November 1994 concerning the compulsory indication on the labelling of certain foodstuffs of particulars other than those provided for in Council Directive 79/112/EEC (3) has been substantially amended several times (4). In the interests of clarity and rationality the said Directive should be codified. |
|
(2) |
In order to ensure that consumers receive adequate information, it is necessary to provide for compulsory indication, for certain foodstuffs, of other particulars in addition to those provided for in Article 3 of Directive 2000/13/EC. |
|
(3) |
Packaging gases used in packaging certain foodstuffs should not be regarded as ingredients for the purposes of Article 6(1) of Directive 2000/13/EC and therefore should not be included in the list of ingredients on the label. |
|
(4) |
However, consumers should be informed of the use of such gases inasmuch as this information enables them to understand why the foodstuff they have purchased has a longer shelf life than similar products packaged differently. |
|
(5) |
With a view to providing adequate consumer information, the labelling of foodstuffs which contain sweeteners should bear details to that effect. |
|
(6) |
Moreover, warnings should also be given on the labelling of foodstuffs containing certain categories of sweetener. |
|
(7) |
Furthermore, it is necessary to provide labelling which gives the consumers clear information on the presence of glycyrrhizinic acid or its ammonium salt in confectionery and beverages. In the case of high contents of glycyrrhizinic acid or its ammonium salt in those products, the consumers, and in particular those suffering from hypertension, should in addition be informed that excessive intake should be avoided. To ensure a good understanding of such information by the consumers, the well known term ‘liquorice’ should be preferably used. |

The measures provided for in this Directive are in conformity with the opinion of the Standing Committee on the Food Chain and Animal Health. |
|
(9) |
This Directive should be without prejudice to the obligations of the Member States relating to the time limits for transposition into national law of the Directives set out in Annex II, Part B, |
HAS ADOPTED THIS DIRECTIVE:
Article 1
Without prejudice to the provisions of Article 3 of Directive 2000/13/EC, the labelling of the foodstuffs listed in Annex I to this Directive shall include additional particulars, as set out in that Annex.
Article 2
Directive 94/54/EC, as amended by the Directives listed in Annex II, Part A, is repealed, without prejudice to the obligations of the Member States relating to the time limits for transposition into national law of the Directives set out in Annex II, Part B.
References to the repealed Directive shall be construed as references to this Directive and shall be read in accordance with the correlation table in Annex III.
Article 3
This Directive shall enter into force on the 20th day following that of its publication in the Official Journal of the European Union.
Article 4
This Directive is addressed to the Member States.

COUNCIL DECISION
of 22 January 2008
authorising the Federal Republic of Germany and the Republic of Poland to apply measures derogating from Article 5 of Council Directive 2006/112/EC on the common system of value added tax

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (1), and in particular Article 395(1) thereof,
Having regard to the proposal from the Commission,
Whereas:

By letters registered with the General Secretariat of the Commission on 22 October 2007 and 27 July 2007, the Federal Republic of Germany and the Republic of Poland requested authorisation to apply special tax measures in relation to the construction and maintenance of certain border bridges between the two countries. |
|
(2) |
In accordance with Article 395(2) of Directive 2006/112/EC, the Commission informed the other Member States by letter dated 24 October 2007 of the requests made by the Federal Republic of Germany and the Republic of Poland. By letter dated 25 October 2007, the Commission notified the Federal Republic of Germany and the Republic of Poland that it had all the information necessary to consider the requests. |
|
(3) |
The purpose of the special measure is, for supplies of goods or services and intra-Community acquisitions of goods intended for the construction and maintenance of the cross-border bridges, the bridges, and its construction site in case of building, should be regarded as being entirely within the territory of one of the Member States in accordance with an agreement concluded between them on the division of responsibility for the construction or maintenance of those cross-border bridges. |
|
(4) |
In the absence of a special measure, it would be necessary, for each supply of goods or services or intra-Community acquisition of goods, to ascertain whether the place of taxation was the Federal Republic of Germany or the Republic of Poland. Work at a border bridge carried out within Germany’s territory would be subject to value added tax in Germany while that carried out within Poland’s territory would be subject to Polish value added tax. |
|
(5) |
The purpose of the derogation is therefore to simplify the procedure for charging the tax on the construction and maintenance of the bridges in question. |
|
(6) |
The derogation will have no negative impact on the Community’s own resources provided from value added tax, |
HAS ADOPTED THIS DECISION:
Article 1
The Federal Republic of Germany and the Republic of Poland are hereby authorised, under the conditions laid down in Articles 2 and 3, to apply measures derogating from Directive 2006/112/EC in relation to the construction and subsequent maintenance of one border bridge crossing the Oder (Odra) and one border bridge crossing the Lausitzer Neiße (Nysa Łużycka), and the maintenance of two existing border bridges over the Oder (Odra) and nine existing border bridges over the Lausitzer Neiße (Nysa Łużycka), all of which are partly within the territory of the Federal Republic of Germany and partly within the territory of the Republic of Poland. Details of the bridges in question are given in the Annex to this Decision. This authorisation shall also apply to any additional bridges which are brought into the scope of the Agreement concluded between the Federal Republic of Germany and the Republic of Poland on the responsibility for the construction or maintenance of trans-border bridges by an exchange of diplomatic notes.
Article 2
By way of derogation from Article 5 of Directive 2006/112/EC, with regard to the border bridges for which the Federal Republic of Germany is responsible for the construction and maintenance and with regard to the border bridges for which the Federal Republic of Germany is solely responsible for maintenance, those bridges and, where appropriate, the construction site insofar as it is within Polish territory, shall be deemed to be part of Germany’s territory for the purposes of supplies of goods and services and intra-Community acquisitions of goods intended for the construction or maintenance of those bridges.
Article 3
By way of derogation from Article 5 of Directive 2006/112/EC, with regard to the border bridges for which the Republic of Poland is responsible for the construction and maintenance and with regard to the border bridges for which the Republic of Poland is solely responsible for maintenance, those bridges and, where appropriate, the construction site insofar as it is within Germany’s territory, shall be deemed to be part of Poland’s territory for the purposes of supplies of goods and services and intra-Community acquisitions of goods intended for the construction or maintenance of those bridges.

This Decision is addressed to the Federal Republic of Germany and to the Republic of Poland.

DECISION No 1/2008 OF THE JOINT COMMITTEE ON AGRICULTURE SET UP BY THE AGREEMENT BETWEEN THE EUROPEAN COMMUNITY AND THE SWISS CONFEDERATION ON TRADE IN AGRICULTURAL PRODUCTS

Having regard to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products, and in particular Article 11 thereof,
Whereas:

This Agreement entered into force on 1 June 2002. |
|
(2) |
The purpose of Annex 4 is to facilitate trade between the Parties in plants, plant products and other objects subject to plant health measures. The said Annex 4 is to be supplemented by a number of Appendices as described in the Joint Declaration on the implementation of Annex 4 annexed to the Agreement (with the exception of Appendix 5, which was adopted at the time the Agreement was concluded). |
|
(3) |
The Appendices to Annex 4 were respectively replaced by Decision No 1/2004 of the Joint Committee on Agriculture, attached to Commission Decision 2004/278/EC (1), and Decision No 2/2005 of the Joint Committee on Agriculture (2). |

Since the entry into force on the above mentioned Decisions, the legislative provisions of the Parties in the plant health field have been amended in areas which affect the Agreement. |
|
(5) |
Following the enlargement of the Community, as well as modifications to the existing list of authorities responsible for issuing the plant passport, the list of these authorities must be supplemented. |

Appendices 1, 2, 3 and 4 to Annex 4 should therefore be amended to take into account these various changes, |

ZONES REFERRED TO IN ARTICLE 4 AND SPECIAL REQUIREMENTS RELATING TO THEM
The zones referred to in Article 4 and the special requirements relating to them which must be complied with by both Parties are defined in the two Parties’ respective legislative and administrative provisions set out below.
European Community provisions
Commission Directive 2001/32/EC of 8 May 2001 recognising protected zones exposed to particular plant health risks in the Community and repealing Directive 92/76/EEC, as last amended by Commission Directive 2006/36/EC
Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community, as last amended by Directive 2006/35/EC
Swiss provisions
