COMMISSION REGULATION (EU) 2015/2293

of 4 December 2015

establishing a prohibition of fishing for cod in NAFO 3M area by vessels flying the flag of Portugal

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1224/2009 of 20 November 2009 establishing a Community control system for ensuring compliance with the rules of the common fisheries policy (1), and in particular Article 36(2) thereof,

Whereas:

(1)

Council Regulation (EU) 2015/104 (2), lays down quotas for 2015.

(2)

According to the information received by the Commission, catches of the stock referred to in the Annex to this Regulation by vessels flying the flag of or registered in the Member State referred to therein have exhausted the quota allocated for 2015.

(3)

It is therefore necessary to prohibit fishing activities for that stock,

HAS ADOPTED THIS REGULATION:

Article 1

Quota exhaustion

The fishing quota allocated to the Member State referred to in the Annex to this Regulation for the stock referred to therein for 2015 shall be deemed to be exhausted from the date set out in that Annex.

Article 2

Prohibitions

Fishing activities for the stock referred to in the Annex to this Regulation by vessels flying the flag of or registered in the Member State referred to therein shall be prohibited from the date set out in that Annex. In particular it shall be prohibited to retain on board, relocate, tranship or land fish from that stock caught by those vessels after that date.

Article 3

Entry into force

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) 2015/2294

of 9 December 2015

amending Regulation (EC) No 1831/2003 of the European Parliament and of the Council as regards the establishment of a new functional group of feed additives

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 6(3) thereof,

Whereas:

(1)

Regulation (EC) No 1831/2003 provides for the allocation of feed additives to categories and further to functional groups within those categories according to their functions and properties.

(2)

As a result of technological and scientific development, some feed additives may improve the hygienic condition of a feed, in particular by reducing a specific microbiological contamination and thereby mitigating the possible adverse effects of microorganisms on animal health.

(3)

In addition to the implementation of the hygienic requirements and good practices along the feed chain, operators may need in specific cases to use hygienic condition enhancers in order to improve the quality of feed for animal nutrition providing additional guarantees for the protection of animal and public health. Since such feed additives cannot be allocated to any of the functional groups provided for in Regulation (EC) No 1831/2003, it is necessary to add a new functional group in the category ‘technological additives’.

(4)

Regulation (EC) No 1831/2003 should therefore be amended accordingly.

(5)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

In point 1 of Annex I to Regulation (EC) No 1831/2003, the following point (n) is added:

‘(n)   hygiene condition enhancers: substances or, when applicable, microorganisms which favourably affect the hygienic characteristics of feed by reducing a specific microbiological contamination.’

Article 2

Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2015/2295

amending Regulation (EC) No 2074/2005 as regards lists of approved food establishments

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules (1), and in particular Article 31(2)(f) thereof,

Whereas:

Regulation (EC) No 882/2004 lays down general rules for the performance of official controls to verify compliance with Union rules on feed and food, animal health and animal welfare. It provides for Member States to maintain up-to-date lists of approved establishments, made available to other Member States and to the public.

(2)

In accordance with the requirements laid down in Commission Regulation (EC) No 2074/2005 (2), the Commission is to provide a website, to which each Member State is to provide a link to its national website containing up-to-date lists of approved establishments, available to other Member States and to the public. The analysis of those lists for purposes such as impact assessment and for making links with other Commission information technology tools has proved to be very time-consuming and complex.

(3)

In order to simplify the possibility to analyse the listing for Member States establishments and to include without undue delay a Union approved establishment in those lists, it seems appropriate to allow the use of TRACES.

(4)

The requirements provided for in this Regulation involve an adaptation of current practices both for food business operators and competent authorities. It is therefore appropriate to allow a delayed application of this Regulation.

(5)

Regulation (EC) No 2074/2005 should therefore be amended accordingly.

(6)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Annex V of Regulation (EC) No 2074/2005 is replaced by the text in Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2016.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

‘ANNEX V

Lists of approved establishments

CHAPTER I

ACCESS TO LISTS OF APPROVED ESTABLISHMENTS

In order to assist Member States in making up-to-date lists of approved food establishments available to other Member States and to the public, the Commission shall provide a website to which each Member State shall provide a link to its national website or inform in case those lists are published through the TRACES system.

CHAPTER II

FORMAT FOR NATIONAL WEBSITES

A.   Masterlist

1.

Each Member State shall provide the Commission with a linking address to a single national website containing the masterlist of lists of approved food establishments for products of animal origin as defined in point 8.1. of Annex I to Regulation (EC) No 853/2004.

2.

The masterlist referred to in point 1 shall consist of one sheet and shall be completed in one or more official languages of the Union.

B.   Operational chart

1.

The website containing the masterlist shall be developed by the competent authority or, where appropriate, one of the competent authorities referred to in Article 4 of Regulation (EC) No 882/2004.

2.

The masterlist shall include links to:

(a)

other web pages located on the same website;

(b)

where certain lists of approved food establishments are not maintained by the competent authority referred to in point 1, websites managed by other competent authorities, units or where appropriate, bodies.

C.   Listing through the TRACES system

By way of derogation from Parts A and B, Member States may provide the lists through the TRACES system.

CHAPTER III

LAYOUT AND CODES FOR LISTS OF APPROVED ESTABLISHMENTS

Layouts, including relevant information and codes, shall be established to ensure wide availability of the information concerning approved food establishments and to improve the readability of the lists.

CHAPTER IV

TECHNICAL SPECIFICATIONS

The tasks and activities referred to in Chapters II and III shall be performed in accordance with the technical specifications published by the Commission.’

amending Implementing Regulation (EU) No 1366/2014 publishing, for 2015, the agricultural product nomenclature for export refunds introduced by Regulation (EEC) No 3846/87

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1),

Having regard to Commission Regulation (EEC) No 3846/87 of 17 December 1987 establishing an agricultural product nomenclature for export refunds (2), and in particular the third paragraph of Article 3 thereof,

Whereas:

The agricultural product nomenclature for export refunds introduced by Regulation (EEC) No 3846/87 was published by Commission Implementing Regulation (EU) No 1366/2014 (3). The final date of application of that Implementing Regulation was laid down as 31 December 2015.

(2)

In order to apply electronic customs procedures on export, it is necessary to encode the product codes and description of the export refund nomenclature (ERN) into the TARIC timely in advance before applying export refunds. It is necessary to extend the validity of the publication of a consolidated version of the ERN should export refunds be introduced on the basis of Regulation (EU) No 1308/2013 after that date.

(3)

The ERN is also used for the national application of special support measures for outermost regions (POSEI). In order to enhance the uniform application of such measures, the publication of the ERN should be extended.

(4)

The amendments introduced in the Combined Nomenclature (CN) for 2016 do not require a technical adaptation of the ERN for 2016.

(5)

The period of application of Implementing Regulation (EU) No 1366/2014 should therefore be extended for another year, i.e. until 31 December 2016,

HAS ADOPTED THIS REGULATION:

Article 1

In the second subparagraph of Article 2 of Implementing Regulation (EU) No 1366/2014 the date ‘31 December 2015’ is replaced by the date ‘31 December 2016’.

Article 2

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing the standard import values for determining the entry price of certain fruit and vegetables

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1),

Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,

Whereas:

(1)

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto.

(2)

The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

POLITICAL AND SECURITY COMMITTEE DECISION (CFSP) 2015/2298

of 26 November 2015

on the appointment of the EU Mission Commander for the European Union military mission to contribute to the training of the Malian Armed Forces (EUTM Mali) and repealing Decision (CFSP) 2015/955 (EUTM Mali/3/2015)

THE POLITICAL AND SECURITY COMMITTEE,

Having regard to the Treaty on European Union, and in particular Article 38 thereof,

Having regard to Council Decision 2013/34/CFSP of 17 January 2013 on a European Union military mission to contribute to the training of Malian Armed Forces (EUTM Mali) (1), and in particular Article 5 thereof,

Whereas:

(1)

Pursuant to Article 5(1) of Decision 2013/34/CFSP, the Council authorised the Political and Security Committee (PSC), in accordance with Article 38 of the Treaty on European Union, to take the relevant decisions concerning the political control and strategic direction of EUTM Mali, including the decisions to appoint the subsequent EU Mission Commanders.

(2)

On 16 June 2015, the PSC adopted Decision (CFSP) 2015/955 (2) appointing Brigadier General Franz Xaver PFRENGLE as EU Mission Commander for EUTM Mali.

(3)

On 30 September 2015, Germany recommended the appointment of Brigadier General Werner ALBL as the new EU Mission Commander for EUTM Mali to succeed Brigadier General Franz Xaver PFRENGLE.

(4)

The EU Military Committee has supported the recommendation.

(5)

Decision (CFSP) 2015/955 should therefore be repealed.

(6)

In accordance with Article 5 of Protocol No 22 on the position of Denmark, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, Denmark does not participate in the elaboration and the implementation of decisions and actions of the Union which have defence implications,

HAS ADOPTED THIS DECISION:

Article 1

Brigadier General Werner ALBL is hereby appointed EU Mission Commander for the European Union military mission to contribute to the training of the Malian Armed Forces (EUTM Mali) from 18 December 2015.

Article 2

Decision (CFSP) 2015/955 is hereby repealed.

Article 3

This Decision shall enter into force on 18 December 2015.

COMMISSION IMPLEMENTING DECISION (EU) 2015/2299

of 17 November 2015

amending Decision 2009/965/EC as regards an updated list of parameters to be used for classifying national rules

(notified under document C(2015) 7869)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2008/57/EC of the European Parliament and of the Council of 17 June 2008 on the interoperability of the rail system within the Community (1), and in particular Article 27(4) thereof,

Whereas:

On 30 November 2009 the Commission adopted Decision 2009/965/EC (2) with a list of parameters to be used for classifying national rules in the reference document referred to in Article 27 of Directive 2008/57/EC.

(2)

On the basis of a recommendation of the European Railway Agency (the Agency), the revision of the list of parameters is needed to make it coherent with the revised technical specification for interoperability (‘TSI’) on rolling stock, freight wagons, locomotives and passenger rolling stock, noise, infrastructure, energy, control-command and signalling, operation and traffic management, telematic applications for freight and passenger services, safety on railway tunnels and accessibility to persons with reduced mobility.

(3)

In order to allow comparison and cross-referencing, in respect of a particular parameter, between the requirements contained within the revised TSIs and those contained in national rules, the list of parameters to be checked in conjunction with the placing in service of non-TSI conform vehicles, should, on the one hand, preserve compatibility with, and build upon existing agreements based on national rules and, on the other hand, reflect the revised TSIs. It is therefore necessary for the list of parameters to be updated. To ensure a harmonised understanding and application of the list, additional explanation should be added. It is appropriate to adopt the detailed list of parameters, prepared on the basis of the recommendation of the Agency (ERA-REC-118-2014/REC) of 11 November 2014, as the basis for the reference document referred to in Article 27(4) of Directive 2008/57/EC.

(4)

Decision 2009/965/EC should therefore be amended accordingly.

(5)

For the sake of clarity, the reference document referred to in Article 27(4) of Directive 2008/57/EC and described in Commission Decision 2011/155/EU (3) should be updated accordingly.

(6)

The measures provided for in this Decision are in accordance with the opinion of the Committee established in accordance with Article 29(1) of Directive 2008/57/EC,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 2009/965/EC is replaced by the text in the Annex to this Decision.

Article 2

This Decision is addressed to the Member States and to the European Railway Agency.

It shall apply from 1 January 2016.

COMMISSION DECISION (EU) 2015/2300

on the payment in euro by the United Kingdom of certain expenditure resulting from sectoral agricultural legislation

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy and repealing Council Regulations (EEC) No 352/78, (EC) No 165/94, (EC) No 2799/98, (EC) No 814/2000, (EC) No 1290/2005 and (EC) No 485/2008 (1), and in particular Article 108 thereof,

Whereas:

(1)

Article 108 of Regulation (EU) No 1306/2013 requires Member States which have not adopted the euro and which decide to pay the expenditure resulting from sectoral agricultural legislation in euro rather than in their national currency to take measures to ensure that the use of the euro does not provide a systematic advantage compared with the use of national currency.

(2)

Commission Decision (EU) 2015/1352 (2) previously approved such measures communicated by the United Kingdom.

(3)

On 30 October 2015, the United Kingdom notified the Commission of its intention to extend the number of measures under which it would pay expenditure in euro rather than in pounds sterling, as well as of the measures that would be applied in accordance with Article 108 of Regulation (EU) No 1306/2013 to ensure that a systematic advantage resulting from the use of the euro rather than the pound sterling does not arise.

The measures planned by the United Kingdom can be summarised as follows:

operators may be paid in euro the amounts laid down in, or resulting from, the Union legislation,

operators shall bear the full exchange-rate risk arising from subsequent conversion into sterling,

operators must make a standing commitment for a minimum of 1 year,

concerning the basic payment and other direct payments as referred to in Regulation (EU) No 1307/2013 of the European Parliament and of the Council (3), operators shall opt for payment in euro when they submit the application as referred to in Article 13(1) of Commission Implementing Regulation (EU) No 809/2014 (4),

concerning market measures under Regulation (EU) No 1308/2013 of the European Parliament and of the Council (5), Council Regulation (EU) No 1370/2013 (6) (other than temporary exceptional aid to farmers in the livestock sector), and Regulation (EU) No 510/2014 of the European Parliament and of the Council (7) and information provision and promotion measures concerning agricultural products under Regulation (EU) No 1144/2014 of the European Parliament and of the Council (8), operators must be approved at least 3 months in advance to be paid in euro; 3 months' notice must also be given to withdraw from the arrangement; new payments in euro are then only possible after a 1-year waiting period,

concerning temporary exceptional aid to farmers in the livestock sectors under Commission Delegated Regulation (EU) 2015/1853 (9), operators shall have opted to receive CAP payments in euro before 17 October 2015.

Those measures are in line with the objective fixed by Regulation (EU) No 1306/2013, namely to prevent a systematic advantage resulting from the use of the euro rather than the national currency. They should therefore be approved.

(6)

For that reason, Decision (EU) 2015/1352 should be repealed and replaced by this Decision,

HAS ADOPTED THIS DECISION:

Article 1

The measures communicated by the United Kingdom on 30 October 2015 concerning the payment in euro of expenditure resulting from sectoral agricultural legislation listed in the Annex and, where applicable, any delegated or implementing acts adopted on the basis of those instruments, are hereby approved.

Article 2

Decision (EU) 2015/1352 is repealed.

Article 3

This Decision is addressed to the United Kingdom of Great Britain and Northern Ireland.

amending Decision 93/195/EEC as regards animal health and veterinary certification conditions for the re-entry of registered horses for racing, competition and cultural events after temporary export to Mexico and the United States of America, and amending Annex I to Decision 2004/211/EC as regards the entry for Mexico in the list of third countries and parts thereof from which imports into the Union of live equidae and semen, ova and embryos of the equine species are authorised

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC (1), and in particular Article 17(3)(a) thereof,

Having regard to Council Directive 2009/156/EC of 30 November 2009 on animal health conditions governing the movement and importation from third countries of equidae (2), and in particular Article 12(1) and (4), and the introductory phrase and points (a) and (b) of Article 19 thereof,

Whereas:

Directive 2009/156/EC lays down animal health conditions for the importation into the Union of live equidae. In accordance with Article 13(1)(b) of that Directive, one of the conditions for the authorisation of imports of equidae into the Union is that the third country has been free from Venezuelan equine encephalomyelitis for a period of 2 years.

(2)

Commission Decision 93/195/EEC (3) provides models of health certificates for the re-entry of registered horses after temporary export to participate in racing, competition and cultural events. The model health certificate in Annex II to that Decision provides, amongst other things, that a registered horse temporarily exported for a period of not more than 30 days must, since its exit from the Union, only have been in the third country from where it is certified for re-entry in the Union or in a third country assigned to the same sanitary group as indicated in Annex I to that Decision.

Commission Decision 2004/211/EC (4) establishes a list of third countries, or parts thereof where regionalisation applies, from which Member States are to authorise the importation of live equidae and semen, ova and embryos thereof and indicates the other conditions applicable to such imports in Annex I thereto (‘the list’). Mexico is included in the list and assigned to sanitary group ‘D’, while the United States is assigned in the list to sanitary group ‘C’.

The list also specifies that the temporary admission of registered horses, the re-entry after temporary export of registered horses for racing, competition and cultural events, imports of registered equidae and equidae for breeding and production, and imports of semen, ova and embryos of the equine species from Mexico are currently not authorised, while such movements of registered horses are authorised from the United States.

Commission Implementing Decision 2014/86/EU (5) was adopted in anticipation of the Théâtre équestre Zingaro cultural event in Mexico-City in 2014. Implementing Decision 2014/86/EU amended Article 1 of Decision 93/195/EEC in order to authorise the re-entry into the Union of registered horses, after temporary export for the purpose of taking part in that event, provided that the registered horses complied with the requirements laid down in a health certificate drawn up in accordance with the model health certificate set out in Annex X to that Decision. Implementing Decision 2014/86/EU also amended Decision 93/195/EEC in order to add a new Annex X setting out that model health certificate.

In addition, Implementing Decision 2014/86/EU amended Decision 2004/211/EC so that the list permits the re-entry of registered horses for racing, competition and cultural events after temporary export, from the Metropolitan area of Mexico-City until 15 April 2014.

The equestrian events of the LG Global Champions Tour will take place under the auspices of the Fédération Equestre Internationale in Miami, in the United States from 7 to 9 April 2016, and in the Metropolitan area of Mexico-City, Mexico, from 15 to 17 April 2016.

Both mentioned events of the LG Global Champions Tour in the United States and in the Metropolitan area of Mexico-City will take place under official veterinary supervision. Given the high degree of that supervision it is possible to lay down specific animal health and veterinary certification conditions for the re-entry of those horses after their temporary export for a period of not more than 30 days to participate in the equestrian events of the LG Global Champions Tour in Miami and subsequently in Mexico-City.

Decision 93/195/EEC should be amended in order to authorise the re-entry into the Union until 30 April 2016 of registered horses for racing, competition and cultural events after temporary export for the purpose of taking part in the LG Global Champion Tour in Miami and in Mexico-City, and to provide for a model health certificate to cover such registered horses. At the same time, the obsolete provisions of Decision 93/195/EEC, as amended by Implementing Decision 2014/86/EU, should be deleted.

Decision 93/195/EEC should therefore be amended accordingly.

As the Metropolitan area of Mexico-city is a region of high altitude with a reduced risk of vector born transmission of vesicular stomatitis or certain subtypes of Venezuelan equine encephalitis, the re-entry of registered horses for racing, competition and cultural events after temporary export for a period of less than 30 days to the Metropolitan area of Mexico-City, a region in which Venezuelan equine encephalomyelitis has not been reported for more than 2 years, should be authorised. The entry for Mexico in the list should therefore be amended in order to permit the re-entry into the Union of registered horses for racing, competition and cultural events after temporary export, from the Metropolitan area of Mexico-city from 30 March 2016 to 30 April 2016.

The entry for that third country in the list in Annex I to Decision 2004/211/EC should therefore be amended.

Decision 2004/211/EC should therefore be amended accordingly.

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

Decision 93/195/EEC is amended as follows:

(1)

in Article 1, the last indent is replaced by the following:

‘—

have taken part in the equestrian events of the LG Global Champions Tour in Miami, United States and Mexico-City, Mexico, and meet the requirements laid down in a health certificate drawn up in accordance with the model health certificate set out in Annex X to this Decision and provided that such re-entry takes place no later than 30 April 2016.’;

Annex X is replaced by the text in Annex I to this Decision.

Article 2

Annex I to Decision 2004/211/EC is amended in accordance with Annex II to this Decision.

Article 3

This Decision is addressed to the Member States.
