COMMISSION IMPLEMENTING REGULATION (EU) 2020/2002
of 7 December 2020
laying down rules for the application of Regulation (EU) 2016/429 of the European Parliament and of the Council with regard to Union notification and Union reporting of listed diseases, to formats and procedures for submission and reporting of Union surveillance programmes and of eradication programmes and for application for recognition of disease-free status, and to the computerised information system
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 23, Article 30(1)(b) and Articles 35 and 40 thereof,
Whereas:
(1) |
Regulation (EU) 2016/429 lays down rules for animal diseases that are transmissible to animals or humans, including provisions for disease notification and reporting, Union surveillance programmes, eradication programmes and disease-free status. |
(2) |
Commission Delegated Regulation (EU) 2020/689 (2) supplements Regulation (EU) 2016/429 and lays down rules on surveillance, eradication programmes and disease-free status for certain listed and emerging animal diseases. The information, formats and procedural requirements for the surveillance, eradication programmes and for disease-free status should be set out in this Regulation. |
(3) |
Listed diseases, as defined in Article 4(18) of Regulation (EU) 2016/429, are listed in accordance with Article 5(1) of that Regulation. Due to their different disease profile, outbreaks of certain of the listed diseases should be subject to immediate Union notification, whereas outbreaks of the others should be subject to Union reporting. |
(4) |
Taking into account the disease profile and the health status of a given Member State, zone or compartment, an immediate Union notification to the Commission and the other Member States about an outbreak of certain of the listed diseases should be required in order to allow a timely implementation of necessary risk management measures. A dedicated list of those listed diseases, for which an immediate Union notification is necessary, as well as the timeframe for such immediate notification, should be set out in this Regulation. |
(5) |
Animal health guarantees apply to disease-free Member States, zones and compartments for listed diseases referred to in points (b) and (c) of Article 9(1) of Regulation (EU) 2016/429. As reporting on surveillance carried out to maintain disease-free status is not mandatory, the obligation to notify primary outbreaks of those diseases within 24 hours of confirmation is justified. |
(6) |
In case of secondary outbreaks of listed diseases subject to notification, the well-established use of grouped weekly notifications is appropriate, considering the disease profile and depending on the health status of a Member State, zone or compartment. |
(7) |
Commission Implementing Regulation (EU) 2018/1882 (3) determines the application of disease prevention and control rules to the categories of listed diseases for the listed species or groups of listed species. Member States’ obligation for Union reporting on detection of category E diseases according to that Regulation for the relevant listed species or groups of listed species, the procedural requirements and information for such reporting, should be laid down in this Regulation. |
(8) |
To ensure uniform conditions for the implementation of Union notification and reporting, the rules to establish the information to be provided, the rules to establish the necessary procedures, formats, data and the rules for the listing of notification and reporting regions should be laid down. |
(9) |
For the purpose of the information to be transmitted when carrying out a Union notification as laid down in Article 19 of Regulation (EU) 2016/429, some of the information requirements should be further detailed to ensure uniform application of that provision and facilitate data entry into the computerised information system referred to in Article 22 of that Regulation (Animal Disease Information System (ADIS)). |
(10) |
For the purpose of Union reporting of listed diseases in accordance with Article 20 of Regulation (EU) 2016/429, the level of information to be provided on the detection of listed diseases and on eradication programmes should be specified in this Regulation. |
(11) |
Article 21 of Regulation (EU) 2016/429 requires Member States to establish notification and reporting regions. In order to ensure clarity in Union notification and reporting, this Regulation should list the types of notification and reporting regions. |
(12) |
Furthermore, it is appropriate to establish harmonised procedures and formats to ensure uniform reporting of the results of Union surveillance programmes and eradication programmes in the ADIS. |
(13) |
The information provided on the results of the implementation of eradication programmes should be available in the ADIS to enable the Commission to monitor the progress of Member States’ ongoing eradication programmes. Such information should be supplemented by additional information for the purpose of recognition of disease-free status once eradication has been achieved. |
(14) |
For listed diseases referred to in points (b) and (c) of Article 9(1) of Regulation (EU) 2016/429, the health status within a Member State’s territory might be different between a part of the territory recognised as disease-free and other parts of the territory with or without an approved eradication programme for the same disease. The ADIS should enable data compilation and, where relevant, integration with additional data regarding the total number of outbreaks and the affected listed species or groups of listed species. |
(15) |
Article 28 of Regulation (EU) 2016/429 requires Member States to submit Union surveillance programmes to the Commission. Article 31 of Regulation (EU) 2016/429 requires Member States to submit compulsory and optional eradication programmes for listed diseases referred to in points (b) and (c) of Article 9(1) of that Regulation. In order to ensure the uniform application of these provisions, a common format and procedure for those submissions should be laid down in this Regulation. |
(16) |
Member States should submit an application to the Commission for approval of disease-free status for category B diseases and category C diseases. In order to ensure the uniform submission of these applications by Member States, it is appropriate to specify the required information, format and means of data transfer for these applications. |
(17) |
As Regulation (EU) 2016/429 applies from 21 April 2021, this Regulation should also apply from that date. |
(18) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:

REGULATION (EU) 2020/2004 OF THE EUROPEAN CENTRAL BANK
of 26 November 2020
amending Regulation (EU) No 1333/2014 concerning statistics on the money markets (ECB/2020/58)
THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Statute of the European System of Central Banks and of the European Central Bank, and in particular Article 5 thereof,
Having regard to Council Regulation (EC) No 2533/98 of 23 November 1998 concerning the collection of statistical information by the European Central Bank (1), and in particular Articles 5(1) and 6(4) thereof,
Whereas:
(1) |
Regulation (EC) No 2533/98 provides that the European Central Bank (ECB) has the right, in duly justified cases, to collect from reporting agents statistical information on a consolidated basis, including information on the entities controlled by them. The ECB specifies the extent of the consolidation for this purpose. For the purposes of the regular production of money market statistics, Regulation (EU) No 1333/2014 of the European Central Bank (ECB/2014/48) (2) requires reporting agents to report to the national central bank of the Member State where they are resident or to the ECB on a consolidated basis, including for all their Union and EFTA-located branches, daily statistical information relating to money market instruments. |
(2) |
The statistical information in respect of reporting agents’ branches in the United Kingdom is significant in terms of its overall volume. Given the reliance of the euro short-term rate (€STR) on the statistical information reported under Regulation (EU) No 1333/2014 (ECB/2014/48), it is necessary to ensure the continued reporting of statistical information for those branches to further ensure the availability of high-quality statistics on the euro money market. |
(3) |
The transition period provided for in the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community will end on 31 December 2020. In order for the European System of Central Banks to continue to receive daily statistical information relating to money market instruments in respect of UK-located branches of reporting agents, the scope of the consolidated reporting with regard to branches in Article 3(1) of Regulation (EU) No 1333/2014 (ECB/2014/48) needs to be widened. |
(4) |
Therefore, Regulation (EU) No 1333/2014 (ECB/2014/48) should be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Amendment
Article 3(1) of Regulation (EU) No 1333/2014 (ECB/2014/48) is replaced by the following:
‘1. For the purposes of the regular production of money market statistics, the reporting agents shall report to the NCB of the Member State where they are resident on a consolidated basis, including for all their Union and EFTA branches as well as for their branches located in the United Kingdom, daily statistical information relating to money market instruments. The required statistical information is specified in Annexes I, II and III. The reporting agents shall report the required statistical information in accordance with the minimum standards for transmission, accuracy, compliance with concepts, revisions and data integrity set out in Annex IV. The NCB shall transmit the statistical information it receives from the reporting agents to the ECB in accordance with Article 4(2) of this Regulation.’.
Article 2
Final provisions
This Regulation shall enter into force on the fourth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in the Member States in accordance with the Treaties.
Done at Frankfurt am Main, 26 November 2020.

COUNCIL IMPLEMENTING DECISION (EU) 2020/2005
of 4 December 2020
granting temporary support under Regulation (EU) 2020/672 to Ireland to mitigate unemployment risks in the emergency following the COVID-19 outbreak
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) 2020/672 of 19 May 2020 on the establishment of a European instrument for temporary support to mitigate unemployment risks in an emergency (SURE) following the COVID-19 outbreak (1), and in particular Article 6(1) thereof,
Having regard to the proposal from the European Commission,
Whereas:
(1) |
On 27 October 2020, Ireland requested financial assistance from the Union with a view to complementing its national efforts to address the impact of the COVID-19 outbreak and respond to the socioeconomic consequences of the outbreak for workers and the self-employed. |
(2) |
The COVID-19 outbreak and the extraordinary measures implemented by Ireland to contain the outbreak and its socioeconomic and health-related impact are expected to have a dramatic impact on public finances. According to the Commission’s 2020 autumn forecast, Ireland is expected to have a general government deficit and debt of 6,8 % and 63,1 % of gross domestic product (GDP) respectively by the end of 2020 and Ireland’s GDP is projected to decrease by 2,3 % in 2020. |
(3) |
The COVID-19 outbreak has immobilised a substantial part of the labour force in Ireland. This has led to a sudden and severe increase in public expenditure in Ireland in respect of the Temporary Wage Subsidy Scheme as set out in recital 4. |
(4) |
The Emergency Measures in the Public Interest (Covid-19) Act 2020 (Article 28) ‘Covid-19: temporary wage subsidy provisions’, which is referred to in Ireland’s request of 27 October 2020, introduced a scheme that subsidises a portion of the employer wage bill in circumstances where the employer’s business has been affected by the restrictions introduced due to the COVID-19 crisis. The scheme is open to employers who retain staff on their payroll and it aims at supporting firms’ viability and preserving the relationship between the employer and employee. The scheme was in place from 26 March 2020 until 31 August 2020. Initially, until 3 May 2020, the subsidy scheme refunded employers up to a maximum of EUR 410 per week for each qualifying employee. From 4 May 2020, the subsidy payment moved to a system based on the previous net weekly pay for each employee, refunding employers between 70 % and 85 % of the employee’s net earnings, subject to a cap of EUR 350 or EUR 410 per week, depending on the salary level. |
(5) |
Ireland fulfils the conditions for requesting financial assistance set out in Article 3 of Regulation (EU) 2020/672. Ireland has provided the Commission with appropriate evidence that the actual public expenditure has increased by EUR 2 473 887 900 as of 1 February 2020 due to the increased amount directly related to the Temporary Wage Subsidy Scheme. This constitutes a sudden and severe increase because the new measure covers a significant proportion of undertakings and of the labour force in Ireland. |
(6) |
The Commission has consulted Ireland and verified the sudden and severe increase in the actual public expenditure directly related to short-time work schemes and similar measures referred to in the request of 27 October 2020, in accordance with Article 6 of Regulation (EU) 2020/672. |
(7) |
Financial assistance should therefore be provided with a view to helping Ireland to address the socioeconomic effects of the severe economic disturbance caused by the COVID-19 outbreak. The Commission should take the decisions concerning maturities, size and release of instalments and tranches in close cooperation with national authorities. |
(8) |
This Decision should be without prejudice to the outcome of any procedures relating to distortions of the operation of the internal market that may be undertaken, in particular under Articles 107 and 108 of the Treaty. It does not override the requirement for Member States to notify instances of potential State aid to the Commission under Article 108 of the Treaty. |
(9) |
The decision to provide financial assistance has been reached taking into account existing and expected needs of Ireland, as well as requests for financial assistance pursuant to Regulation (EU) 2020/672 already submitted or planned to be submitted by other Member States, while applying the principles of equal treatment, solidarity, proportionality and transparency, |
HAS ADOPTED THIS DECISION:
Article 1
Ireland fulfils the conditions set out in Article 3 of Regulation (EU) 2020/672.
Article 2
1. The Union shall make available to Ireland a loan amounting to a maximum of EUR 2 473 887 900. The loan shall have a maximum average maturity of 15 years.
2. The availability period for financial assistance granted by this Decision shall be 18 months starting from the first day after this Decision has taken effect.
3. The Union financial assistance shall be made available by the Commission to Ireland in a maximum of eight instalments. An instalment may be disbursed in one or several tranches. The maturities of the tranches under the first instalment may be longer than the maximum average maturity referred to in paragraph 1. In such cases, the maturities of further tranches shall be set so that the maximum average maturity referred to in paragraph 1 is respected once all instalments have been disbursed.
4. The first instalment shall be released subject to the entry into force of the loan agreement provided for in Article 8(2) of Regulation (EU) 2020/672.
5. Ireland shall pay the cost of the funding of the Union referred to in Article 4 of Regulation (EU) 2020/672 for each instalment plus any fees, costs and expenses of the Union resulting from any funding related to the loan granted under paragraph 1 of this Article.
6. The Commission shall decide on the size and release of instalments, as well as on the size of the tranches.
Article 3
Ireland may finance the Temporary Wage Subsidy Scheme, which subsidises a portion of the employer wage bill in circumstances where the employer’s business has been affected by the restrictions introduced due to the COVID-19 crisis and where the employment relationship is maintained, as provided for in the Emergency Measures in the Public Interest (Covid-19) Act 2020 (Article 28) ‘Covid-19: temporary wage subsidy provisions’.
Article 4
This Decision is addressed to Ireland.
This Decision shall take effect on the date of its notification to the addressee.
Article 5
This Decision shall be published in the Official Journal of the European Union.
Done at Brussels, 4 December 2020.
For the Council
The President
M. ROTH
