amending Delegated Regulation (EU) 2019/1122 as regards the modernisation of the functioning of the Union Registry

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a system for greenhouse gas emission allowance trading within the Union and amending Council Directive 96/61/EC (1), and in particular Article 19(3) thereof,
Whereas:

Article 19(1) of Directive 2003/87/EC, before its amendment by Directive 2009/29/EC of the European Parliament and of the Council (2), required Member States to provide for the establishment and maintenance of a registry to ensure the accurate accounting of the issue, holding, transfer and cancellation of greenhouse gas emission allowances. For that purpose, Article 19(3) of Directive 2003/87/EC and Article 3 of Commission Regulation (EC) No 2216/2004 (3) created a system for the trading of greenhouse gas emission allowances which became operational in January 2005. That system ensured the accurate accounting of all greenhouse gas emission allowances issued under the emissions trading system of the Union (‘EU ETS’) and kept track of the ownership of EU ETS allowances held in electronic accounts. It consisted of the registries of all Member States and a Central Administrator, designated by the Commission, that was to maintain an independent transaction log recording the issue, transfer and cancellation of allowances. That independent transaction log, the Community Independent Transaction Log (CITL), was created pursuant to Article 5 of Regulation (EC) No 2216/2004. That CITL checked, recorded, and authorised automatically all transactions that took place between accounts in the national registries. Where irregularities were identified through the automated checks, the CITL would terminate the transactions tainted by such irregularities and the central administrator had to inform the Member State or the Member States concerned thereof. In addition, that Member State or those Member States were held not to register the transactions or any other transaction relating to the allowances concerned until the irregularities had been solved. |

Article 19(1) of Directive 2003/87/EC was amended by Directive 2009/29/EC, which replaced the national registries with a Union Registry. Article 3 of Directive 2009/29/EC, however, contained a transitional provision, due to which the provisions of Directive 2003/87/EC were to continue to apply until 31 December 2012. The CITL was, in the meantime, replaced by the European Union Transaction Log (‘EUTL’), which was established by Article 4 of Commission Regulation (EU) No 920/2010 (4). That Commission Regulation was replaced by Commission Regulation (EU) No 389/2013 (5), which in its Article 4 established the Union Registry. That Commission Regulation was, in its turn and save for its Article 3, point (30), replaced by Commission Delegated Regulation (EU) 2019/1122 (6). Delegated Regulation (EU) 2019/1122 now thus contains the rules for the functioning of the Union Registry for phase 4 of the EU emissions trading system (EU ETS), which started on 1 January 2021, and all EU ETS allowances issued from 1 January 2012 onwards are to be held in the Union Registry. As a result of the centralisation of the registries, the EUTL has become part of the Union Registry, which should be reflected in Delegated Regulation (EU) 2019/1122. The Union Registry thus performs, since 1 January 2012, all the functions of the EUTL. |

As part of the modernisation of the IT infrastructure of the Union Registry, its role and possible evolution are periodically reassessed by the Commission as the central administrator in order to remove IT redundancies (i.e. reference to some IT components instead of functions or checks) and prepare the infrastructure for future evolutions of the IT framework, however without affecting its functionality or security. While such modernisation will affect the way the automated checks are performed, all the checks prescribed by Article 20(2) of Directive 2003/87/EC ensuring that there are no irregularities when issuing, transferring or cancelling allowances, should be maintained. |

Currently, users of the Union Registry can initiate transfers without any limitations depending on the thresholds (value) of the transfer. To improve the security of high value transactions, the use of trusted account lists for transactions above a particular threshold should be mandatory. |

In its Communication of 13 October 2021 on rising energy prices (7), the Commission asked the European Securities Market Authority to examine more closely patterns of trading behaviours and the potential need for targeted actions on the European carbon market. One of the important sources for that analysis by the European Securities Market Authority were the Union Registry data on the ownership and transfers of allowances in the Union Registry. The analysis showed that for market monitoring purposes, it would be beneficial to add to Delegated Regulation (EU) 2019/1122 a requirement to identify transactions of emission allowances between account holders that are part of the same group. At this moment, information on the group structure is required only for operator holding accounts. The requirement to provide this information should be introduced for trading accounts as well. |

Article 80(3) of Delegated Regulation (EU) 2019/1122 lists entities that can obtain data from the Union Registry. Council Regulation (EU) 2017/1939 (8) established the European Public Prosecutor’s Office (EPPO), which is responsible for investigating, prosecuting and bringing to judgment crimes against the financial interests of the Union since 1 June 2021. Those crimes include several types of fraud, VAT fraud with damages above 10 million euro, money laundering, corruption, etc. It is therefore appropriate to add the EPPO to the entities listed in Article 80(3) of Delegated Regulation (EU) 2019/1122. |

Delegated Regulation (EU) 2019/1122 should therefore be amended accordingly. |

The data reconciliation process referred to in Article 73 shall be final when all inconsistencies for a specific time and date for specific accounts or holdings of allowances have been resolved, and the data reconciliation process has been successfully re-initiated and completed.’ |

Article 2

COMMISSION IMPLEMENTING REGULATION (EU) 2023/1643

amending Annexes I and II to Implementing Regulation (EU) 2023/594 laying down special control measures for African swine fever

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 71(3) thereof and 259(1),
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and their exports to third countries. |
(2) |
Commission Implementing Regulation (EU) 2023/594 (2) lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States, which are listed or which have areas listed in Annexes I and II thereto (the Member States concerned). Annex I to that Implementing Regulation lists restricted zones I, II and III following outbreaks of that disease. |

The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594 are based on the epidemiological situation of African swine fever in the Union. Annexes I and II to Implementing Regulation (EU) 2023/594 were last amended by Commission Implementing Regulation (EU) 2023/1590 (3) following changes in the epidemiological situation as regards that disease in Bulgaria, Croatia, Germany, Estonia, Greece, Latvia and Poland. Since the date of adoption of that Implementing Regulation, the epidemiological situation as regards that disease in certain Member States concerned has evolved. |

Any amendments to the restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health (WOAH) and justifications for zoning provided by the competent authorities of the Member States concerned. |

Commission Delegated Regulation (EU) 2020/687 (6) supplements the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b) and (c), of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Implementing Regulation (EU) 2018/1882 (7). In particular, Articles 22, 25 and 40 of Delegated Regulation (EU) 2020/687 provide for certain measures to be taken in the event of an official confirmation of an outbreak of a category A disease in kept animals, including African swine fever in kept porcine animals. Notably, those measures provide for the establishment of restricted zones and prohibitions on movements of kept animals of listed species and products of animal origin thereof. |

Since the date of adoption of Implementing Regulation (EU) 2023/1590 amending Implementing Regulation (EU) 2023/594, there have been new outbreaks of African swine fever in kept porcine animals in Bulgaria, Croatia, Latvia and Poland as well as new outbreaks of African swine fever in wild porcine animals in Czechia, Germany, Italy and Poland. |

Following those recent outbreaks of African swine fever in kept porcine animals in Bulgaria, Croatia, Latvia and Poland, as well as outbreaks of African swine fever in wild porcine animals in Czechia, Germany, Italy and Poland and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in those Member States has been reassessed and updated in accordance with Articles 6 and 7 of Implementing Regulation (EU) 2023/594. In addition, the risk management measures in place have been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2023/594. |

In August 2023, an outbreak of African swine fever in kept porcine animals was observed in the Lovech municipality in Bulgaria, in areas currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594. This new outbreak of African swine fever in kept porcine animals constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Bulgaria currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594, affected by those recent outbreaks, should instead be listed as restricted zones III in that Annex, and the current boundaries of restricted zones II need to be redefined to take account of those outbreaks. |

In August 2023, several outbreaks of African swine fever in wild porcine animals were observed in the Liberecký Region in Czechia, in an area currently listed as a restricted zone II in Annex I to Implementing Regulation (EU) 2023/594 located in close proximity to an area currently listed as a restricted zone I in that Annex. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of the Czech Republic currently listed as a restricted zone I in that Annex, that is in close proximity to the area listed as a restricted zone II affected by those recent outbreaks of African swine fever, should now be listed as a restricted zone II in that Annex instead of as a restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks. |

In August 2023, two outbreaks of African swine fever in kept porcine animals were observed in the Madonas and Jekabpils Counties in Latvia, in areas currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594. Those new outbreaks of African swine fever in kept porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Latvia currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594, affected by those recent outbreaks, should instead be listed as restricted zones III in that Annex, and the current boundaries of restricted zones II need to be redefined to take account of those outbreaks. |

Also, in August 2023, two outbreaks of African swine fever in kept porcine animals were observed in the Lubelskie Region in Poland, in an area currently listed as a restricted zone II in Annex I to Implementing Regulation (EU) 2023/594. Those new outbreaks of African swine fever in kept porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently listed as a restricted zone II in Annex I to Implementing Regulation (EU) 2023/594, affected by those recent outbreaks, should instead be listed as a restricted zone III in that Annex, and the current boundaries of restricted zone II need to be redefined to take account of those outbreaks. |

Additionally, in August 2023, several outbreaks of African swine fever in wild porcine animals were observed in the Świętokrzyskie and Opolskie Regions in Poland, in areas currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594 located in close proximity to areas currently listed as restricted zones I in that Annex. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Poland currently listed as restricted zones I in that Annex, that are in close proximity to the areas listed as restricted zones II affected by those recent outbreaks of African swine fever, should now be listed as restricted zones II in that Annex instead of as restricted zones I thereof and the current boundaries of restricted zones I also need to be redefined to take account of those recent outbreaks. |

Further, in August 2023, several outbreaks of African swine fever in wild porcine animals were observed in the State of Brandenburg in Germany, in an area currently listed as a restricted zone II in Annex I to Implementing Regulation (EU) 2023/594 located in close proximity to an area currently listed as a restricted zone I in that Annex. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Germany currently listed as a restricted zone I in that Annex, that is in close proximity to the area listed as a restricted zone II affected by those recent outbreaks of African swine fever, should now be listed as a restricted zone II in that Annex instead of as a restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks. |

Also, considering the overall epidemiological situation of African swine fever in Italy and the outbreaks of African swine fever in wild porcine animals in the Campania region, those areas of Italy affected by those outbreaks of African swine fever, should be listed for a longer time period in Part A of Annex II to Implementing Regulation (EU) 2023/594. Accordingly, the infected zone in that Annex should now be listed until September 2023. |

Finally, in August 2023, an outbreak of African swine fever in kept porcine animals was observed in the Vukovar Srijem County in Croatia, in an area currently listed as a surveillance zone in Annex II to Implementing Regulation (EU) 2023/594. This new outbreak of African swine fever in kept porcine animals constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Croatia currently listed as a surveillance zone in that Annex affected by this recent outbreak of African swine fever, should now be listed as a protection zone in that Annex instead of as a surveillance zone thereof and the current boundaries of the surveillance zone also needs to be redefined to take account of this recent outbreak. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner new restricted zones of a sufficient size should be demarcated for Bulgaria, Czechia, Germany, Latvia and Poland and listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594, new restricted zones should be demarcated for Croatia and listed as protection zone in Annex II to that Regulation, and the existing infected zones for Italy listed in Annex II to that Regulation should be extended. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the epidemiological situation in the surrounding areas. |

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annexes I and II to Implementing Regulation (EU) 2023/594 by this Regulation take effect as soon as possible. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Amendments to Implementing Regulation (EU) 2023/594
Annexes I and II to Implementing Regulation (EU) 2023/594 are replaced by the text set out in the Annex to this Regulation.
Article 2
Entry into force
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/1644
of 17 August 2023
amending Annexes V and XIV to Implementing Regulation (EU) 2021/404 as regards the entries for the United Kingdom and the United States in the lists of third countries authorised for the entry into the Union of consignments of poultry, germinal products of poultry and fresh meat of poultry and game birds

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 230(1) and 232(1) and (3) thereof,
Whereas:

Regulation (EU) 2016/429 provides that consignments of animals, germinal products and products of animal origin must come from a third country or territory, or zone or compartment thereof, listed in accordance with Article 230(1) of that Regulation in order to enter the Union. |
(2) |
Commission Delegated Regulation (EU) 2020/692 (2) lays down the animal health requirements that consignments of certain species and categories of animals, germinal products and products of animal origin, from third countries or territories, or zones thereof, or compartments thereof in the case of aquaculture animals, must comply with in order to enter the Union. |
(3) |
Commission Implementing Regulation (EU) 2021/404 (3) establishes the lists of third countries, or territories, or zones or compartments thereof, from which the entry into the Union of the species and categories of animals, germinal products and products of animal origin falling within the scope of Delegated Regulation (EU) 2020/692 is permitted. |
(4) |
More particularly, Annexes V and XIV to Implementing Regulation (EU) 2021/404 set out the lists of third countries, or territories, or zones thereof authorised for the entry into the Union, respectively, of consignments of poultry, germinal products of poultry, and of fresh meat of poultry and game birds. |
(5) |
The United Kingdom has notified the Commission of three outbreaks of highly pathogenic avian influenza (HPAI) in poultry in Scotland, in the council areas of Aberdeenshire (1) and Highland (1), and the Isle of Lewis (1) which were confirmed on 8 August 2023 and 9 August 2023 by laboratory analysis (RT-PCR). |

Furthermore, the United States has notified the Commission of two outbreaks of highly pathogenic avian influenza (HPAI) in poultry in the state of New York, which were confirmed on 29 July 2023 and 3 August 2023 by laboratory analysis (RT-PCR). |
(7) |
Following those recent outbreaks of HPAI, the veterinary authorities of the United Kingdom and the United States established restricted zones of at least 10 km around the affected establishments and implemented a stamping-out policy in order to control the presence of HPAI and limit the spread of that disease. |
(8) |
The United Kingdom and the United States have submitted information to the Commission on the epidemiological situation on their territories and the measures taken to prevent the further spread of HPAI. |
(9) |
That information has been evaluated by the Commission. The Commission considers that, in view of the animal health situation in the areas under restrictions established by the veterinary authorities of the United Kingdom and the United States, the entry into the Union of consignments of poultry, germinal products of poultry, and fresh meat of poultry and game birds from those areas should be suspended, in order to protect the animal health status of the Union. |

The United Kingdom has provided updated information in relation to epidemiological situation on its territory as regards HPAI that gave rise to the suspension of the entry of certain products into the Union, as set out in Annexes V and XIV to Implementing Regulation (EU) 2021/404. |
(11) |
In particular, the United Kingdom has submitted updated information on the epidemiological situation on its territory in relation to an outbreak of HPAI in a poultry establishment in the country of Cumbria, England, which was confirmed on 2 July 2023. |
(12) |
The United Kingdom also submitted information on the measures that were taken to prevent the further spread of HPAI. In particular, following those outbreaks of that disease, the United Kingdom has implemented a stamping out policy in order to control and limit the spread of that disease, and it has also completed the requisite cleaning and disinfection following the implementation of the stamping out policy on the infected poultry establishment on its territory. |
(13) |
The Commission has evaluated the information submitted by the United Kingdom. The Commission considers that the United Kingdom has provided appropriate guarantees that the animal health situation that gave rise to the suspension, no longer represents a threat to animal or public health within the Union, and that, consequently, the entry into the Union of poultry commodities from the concerned zone the United Kingdom from which entry into the Union had been suspended, should be reauthorised. |
(14) |
Annexes V and XIV to Implementing Regulation (EU) 2021/404 should therefore be amended to take account of the current epidemiological situation as regards HPAI in the United Kingdom and the United States. |
(15) |
Taking into account the current epidemiological situation in the United Kingdom and the United States as regards HPAI, the amendments to be made to Annexes V and XIV to Implementing Regulation (EU) 2021/404 by this Regulation should take effect as a matter of urgency. |
(16) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annexes V and XIV to Implementing Regulation (EU) 2021/404 are amended in accordance with the Annex to this Regulation.
Article 2
Entry into force and applicability
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (3) as required by Article 50(2)(a) of that Regulation. |

HAS ADOPTED THIS REGULATION:
Article 1

Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

amending Implementing Decision (EU) 2021/76 as regards harmonised standards on safety rules for the construction and installation of lifts

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,
Whereas:

In accordance with Article 14 of Directive 2014/33/EU of the European Parliament and of the Council (2), lifts and safety components for lifts which are in conformity with harmonised standards, or parts thereof, the references of which have been published in the Official Journal of the European Union, are to be presumed to be in conformity with the essential health and safety requirements set out in Annex I of that Directive covered by those standards or parts thereof. |

By Commission Implementing Decision C(2016) 5884 (3), the Commission made a request to European Committee for Standardization (CEN) for the drafting of harmonised standards by revising existing harmonised standards in support of Directive 2014/33/EU to ensure that they continue to reflect the generally acknowledged state of the art in order to meet the essential health and safety requirements set out in Annex I to Directive 2014/33/EU and, where relevant, with the essential health and safety requirements set out in Annex I to Directive 2006/42/EC of the European Parliament and of the Council (4) as set out in point 1.1 of Annex I to Directive 2014/33/EU. |

On the basis of the request set out in Commission Implementing Decision C(2016) 5884, CEN revised harmonised standards EN 81-21:2009 as amended by EN 81-21:2009+A1:2012, EN 81-28:2003, EN 81-58:2003, EN 81-70:2003 as amended by EN 81-70:2003/A1:2004 and harmonised standard EN 81-77:2013, the reference of which are published by Commission Implementing Decision (EU) 2021/76 (5). The revision was carried out to adapt those standards to the legal framework of Directive 2014/33/EU and to increase legal certainty and clarity by providing more precise information in Annex ZA of those standards and by dating normative references. As a result, CEN adopted the standards EN 81-21:2022 on new passenger and goods passenger lifts in existing building, EN 81-28:2022 on remote alarm on passenger and goods passenger lifts, EN 81-58:2022 on landing doors fire resistance test, EN 81-70:2021+A1:2022 on accessibility to lifts for persons including persons with disability, and harmonised standard EN 81-77:2022 on lifts subject to seismic conditions, but no substantive technical changes were made to these standards. |

The Commission, together with CEN, has assessed whether harmonised standards EN 81-21:2022, EN 81-28:2022, EN 81-58:2022, EN 81-70:2021+A1:2022, and harmonised standard EN 81-77:2022 comply with the request set out in Implementing Decision C(2016) 5884. |

Harmonised standards EN 81-21:2022, EN 81-28:2022, EN 81-58:2022, EN 81-70:2021+A1:2022, and EN 81-77:2022 satisfy the essential health and safety requirements which they aim to cover and which are set out in Directive 2014/33/EU. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union. |

Implementing Decision (EU) 2021/76 provides in Annex I thereto the references of harmonised standards conferring a presumption of conformity with Directive 2014/33/EU. In order to ensure that the references of harmonised standards drafted in support of Directive 2014/33/EU are listed in one act, the references of harmonised standards EN 81-21:2022, EN 81-28:2022, EN 81-58:2022, EN 81-70:2021+A1:2022, and EN 81-77:2022 should be included in that Annex. |

It is necessary to withdraw the references of harmonised standards EN 81-21:2009 as amended by EN 81-21:2009+A1:2012, EN 81-28:2003, EN 81-58:2003, EN 81-70:2003 as amended by EN 81-70:2003/A1:2004 and harmonised standard EN 81-77:2013 of the Official Journal of the European Union, given that those standards have been revised. It is therefore appropriate to delete those references from Annex I to Implementing Decision (EU) 2021/76. |
(8) |
Implementing Decision (EU) 2021/76 should therefore be amended accordingly. |
(9) |
In order to give manufacturers sufficient time to prepare for the application of the revised standards, it is necessary to defer the withdrawal of references of harmonised standards EN 81-21:2009 as amended by EN 81-21:2009+A1:2012, EN 81-28:2003, EN 81-58:2003, EN 81-70:2003 as amended by EN 81-70:2003/A1:2004 and harmonised standard EN 81-77:2013. |
(10) |
Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should enter into force on the day of its publication, |
HAS ADOPTED THIS DECISION:
Article 1
Annex I to Implementing Decision (EU) 2021/76 is amended in accordance with the Annex to this Decision.
Article 2
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
Points (1), (3), (5), (7) and (9) of the Annex shall apply from 21 February 2025.
