BESCHIKKING VAN DE RAAD

van 12 februari 1990

houdende machtiging tot stilzwijgende verlenging of handhaving van de bepalingen betreffende aangelegenheden die vallen onder de gemeenschappelijke handelspolitiek en die vervat zijn in de tussen de Lid-Staten en derde landen gesloten vriendschaps-, handels- en scheepvaartverdragen en soortgelijke akkoorden

DE RAAD VAN DE EUROPESE GEMEENSCHAPPEN,

Gelet op het Verdrag tot oprichting van de Europese Economische Gemeenschap, inzonderheid op artikel 113,

Gelet op Beschikking 69/494/EEG van de Raad van 16 december 1969 betreffende de geleidelijke eenmaking van de akkoorden inzake de handelsbetrekkingen tussen de Lid-Staten en derde landen en betreffende onderhandelingen over communautaire akkoorden (1), inzonderheid op artikel 3,

Gezien het voorstel van de Commissie,

Overwegende dat voor de door de Lid-Staten gesloten vriendschaps-, handels- en scheepvaartverdragen en soortgelijke akkoorden laatstelijk bij Beschikking 89/150/EEG (2) machtiging werd verleend tot stilzwijgende verlenging of handhaving tot na de overgangsperiode;

Overwegende dat de betrokken Lid-Staten om machtiging hebben verzocht om de bepalingen van de in de bijlage genoemde vriendschaps-, handels- en scheepvaartverdragen en soortgelijke akkoorden die betrekking hebben op aangelegenheden die vallen onder de gemeenschappelijke handelspolitiek in de zin van artikel 113 van het Verdrag stilzwijgend te verlengen of te handhaven, ten einde een onderbreking in hun op overeenkomst berustende handelsbetrekkingen met de betrokken derde landen te vermijden;

Overwegende echter, dat voor het merendeel van de terreinen die onder bovenbedoelde bepalingen van de nationale verdragen en akkoorden vallen, voortaan communautaire akkoorden gelden; dat het, onder deze omstandigheden, enkel gaat om het verlenen van machtiging tot het handhaven van deze bepalingen voor de terreinen die niet onder communautaire akkoorden vallen; dat deze machtiging overigens geen afbreuk kan doen aan de verplichting van de Lid-Staten om elke onverenigbaarheid tussen deze verdragen en akkoorden en de bepalingen van het communautaire recht te vermijden en, in voorkomend geval, ongedaan te maken;

Overwegende voorts dat gedurende de betrokken periode de bepalingen van de stilzwijgend te verlengen of te handhaven verdragen en akkoorden geen belemmering hoeven te vormen voor de tenuitvoerlegging van de gemeenschappelijke handelspolitiek;

Overwegende dat de betrokken Lid-Staten hebben verklaard dat de stilzwijgende verlenging of de handhaving van deze verdragen en akkoorden het openen van communautaire handelsbesprekingen met de betrokken derde landen en het overnemen van de in de geldende bilaterale akkoorden voorkomende bepalingen op het gebied van de handel in de communautaire akkoorden niet in de weg staat;

Overwegende dat na het overleg, voorgeschreven bij artikel 2 van Beschikking 69/494/EEG, is vastgesteld, zoals blijkt uit bovengenoemde verklaringen van de betrokken Lid-Staten, dat de bepalingen van de desbetreffende bilaterale verdragen en akkoorden gedurende de overwogen periode geen belemmering vormen voor de tenuitvoerlegging van de gemeenschappelijke handelspolitiek;

Overwegende evenwel dat de betrokken Lid-Staten, voor zover de stilzwijgende verlenging of de handhaving van de bepalingen die betrekking hebben op aangelegenheden die vallen onder artikel 113 van het Verdrag gedurende de overwogen periode een belemmering zou blijken te

vormen voor de tenuitvoerlegging van de gemeenschappelijke handelspolitiek, zich bereid hebben verklaard deze verdragen en akkoorden aan te passen of, in voorkomend geval, op te zeggen;

Overwegende dat de betrokken verdragen en akkoorden opzeggingstermijnen bevatten van drie tot twaalf maanden;

Overwegende dat er derhalve geen enkel beletsel bestaat voor de stilzwijgende verlenging of handhaving van de betrokken bepalingen tot en met 31 december 1991,

HEEFT DE VOLGENDE BESCHIKKING VASTGESTELD:

Artikel 1

De bepalingen betreffende aangelegenheden die vallen onder de gemeenschappelijke handelspolitiek in de zin van artikel 113 van het Verdrag en die zijn vervat in de in de bijlage vermelde vriendschaps-, handels- en scheepvaartverdragen en soortgelijke akkoorden, mogen stilzwijgend worden verlengd of gehandhaafd tot en met 31 december 1991 voor de terreinen die niet onder akkoorden tussen de Gemeenschap en de betrokken derde landen vallen en voor zover zij niet in strijd zijn met de bestaande gemeenschappelijke politiek.

Artikel 2

Deze beschikking is gericht tot de Lid-Staten.
