A recent European Court of Justice ruling clarifies that even verbal disclosures of personal data fall under GDPR if the source is a written record. The case involved Endemol Shine Finland seeking verbal information from a court and impacts data handling practices, emphasising that both written and verbal disclosures must comply with data protection laws. In the UK, similar legal principles are expected to apply. Ensure all data sharing, even verbally, has a sound legal basis to stay compliant. In Sweden 🇸🇪, if a regulated media company (under Mediemyndigheten - Swedish Agency for the Media), in this case Lexbase AB does not delete information about you as they are required to under the GDPR 🇪🇺, are they open to be criminal litigated against for defamation? A new case has been referred to the Court of Justice of the European Union ⚖️🇪🇺 by the Attunda tingsrätt ⚖️🇸🇪 in Stockholm asking such a question, and moreover, whether appropriate damages must be paid. DPCMO report the Danish Copyright Licence Tribunal has ruled that the Tribunal has jurisdiction to hear DPCMO's claims for data disclosure and remuneration. LinkedIn had filed a motion to dismiss the case. The decision, 32 pages published today, will also have an impact on DPCMO's disputes with Meta, TikTok and YouTube. Both the DSM Directive and the CRM Directive (2014/26/EU) are relevant in the case. On 2 July 2024, Lithuanian data protection supervisory authority – State Data Protection Inspectorate (SDPI), decided to impose an administrative fine of EUR 2 385 276 on Vinted, UAB (the company), the operator of the online second-hand clothing trading and exchange platform “Vinted”. The fine was imposed by the SDPI following the examination of the applicants’ complaints forwarded by the French and Polish supervisory authorities and finding the infringements of Article 5(1)(a) of the General Data Protection Regulation (GDPR) (the principles of lawfulness, fairness and transparency), Article 5(2) of the GDPR (the principle of accountability), and Articles 12(1) and 12(4) of the GDPR (transparent information, communication and conditions for the exercise of the data subject’s rights). https://lnkd.in/dMMtGp9y #gdprfine #vinted #DPA #dataprotection
