About us

ǼLEX is a full service commercial & dispute resolution law firm. It was established in 2004 through the merger of the practice of a Senior Advocate of Nigeria and three other leading commercial law firms in Nigeria. The merger established one of the largest and most diversified law practices in West Africa with offices in Lagos, Port Harcourt and Abuja in Nigeria and Accra, Ghana. Lawyers in the firm are admitted to practice in several jurisdictions including Nigeria, New York, Ghana, England and Wales. In addition to legal qualifications, lawyers in the firm are qualified in disciplines such as political science, economics and engineering. Our lawyers have developed skills and gained a significant deal of experience from their involvement in transactions and projects. Our regular interaction with industry operators enables us to structure our advice on projects and transactions in anticipation of, and consistent with changes in policy and regulation. Our clients are predominantly multinational companies, banks and financial institutions, airlines, oil and gas companies, insurance companies, shipping lines and manufacturing conglomerates. We also advise foreign embassies, multilateral agencies, non-governmental organizations, international chambers of commerce and private clients. In a landmark ruling on 22 November, 2024, the Supreme Court nullified the National Lottery Act 2005, transferring regulatory authority exclusively to state governments. This decision resolves longstanding conflicts and redefines the playing field for lottery operators—introducing both new challenges and exciting opportunities for revenue growth and innovation. This article explores the implications of this historic ruling, examining its impact on localised regulation, the complexities of remote operations, and the future of gaming in Nigeria. Here are some key points from the article: • The Supreme Court nullified the National Lottery Act 2005, transferring lottery regulation exclusively to state governments. • Prior to this decision, a dual regulatory regime existed, causing confusion due to overlapping federal and state requirements. • The challenge, led by Lagos State and others, argued that lottery regulation is constitutionally a state matter. • The Court ruled unanimously that lotteries are not part of trade or commerce as defined in the Constitution. • This decision empowers states to tailor regulations to local needs while enhancing consumer protection. • Lottery operators now face increased compliance complexities, especially for businesses offering remote services across multiple states. • The ruling opens opportunities for revenue growth and innovation, but also raises challenges in enforcing penalties and harmonising diverse state regulations.
