BPA JUDICIAL INSIGHT ⚖️ Supreme Court Highlights Importance of Clear Grounds of Appeal in ATUGUBA & ASSOCIATES V. SCIPION CAPITAL On April 3, 2019, the Supreme Court delivered a pivotal ruling in the case of ATUGUBA & ASSOCIATES v. SCIPION CAPITAL (UK) LTD and HOLMAN FENWICK WILLIAN LLP, which centered on proper procedural practices in the appellate process. The case involved a dispute over legal fees between a Ghanaian law firm and a UK-based partnership, with the Appellant appealing based solely on the claim that the judgment was against the weight of evidence. The Court emphasized the need for appellants to formulate specific grounds of appeal instead of relying on the omnibus ground. It clarified that when an appeal is based solely on the weight of evidence, parties cannot introduce legal arguments if factual issues do not allow for such discussions. This ruling serves as a significant reminder of the importance of clearly defined grounds in the appellate process to facilitate efficient and fair judicial review.
