ASIC has released CP 381 Updates to INFO 225: Digital Assets: Financial Products and Services 🚀 This marks a significant step in providing clarity for the digital asset space under Australia’s financial services laws. Highlights of the proposed updates include: 🔹 Expanded Definitions: Covering crypto-assets, tokenised assets, stablecoins, and wrapped tokens. 🔹 Clear Financial Product Criteria: Defining when digital assets like derivatives, securities, or stablecoins fall within existing regulations. 🔹 Market Licensing Guidance: Addressing platforms facilitating financial product trading. 🔹 Custodial Responsibilities: Enhanced focus on obligations for digital asset providers. 🔹 Retail Investor Protections: Stronger emphasis on disclosures and risk management. With 13 worked examples, ASIC aims to clarify the regulatory treatment of various scenarios, from exchange tokens to tokenised securities and NFTs. The proposed “class no-action” relief offers businesses a pathway to compliance while applying for required licenses.
