Assegaf Hamzah & Partners (AHP), in collaboration with the Singapore International Arbitration Centre (SIAC), recently hosted a fireside chat exploring "The 2025 SIAC Rules and Navigating Indonesia's New Constitutional Court Ruling: Emerging Trends in International Arbitration and What it Means for Businesses." Our Partners Eri Hertiawan and Simon Barrie Sasmoyo Adiwidagdo, FCIArb joined SIAC's Senior Strategy & Development Manager (legal) Sue Ann Mah and Counsel Sherly Gunawan, FCIArb in a discussion moderated by our Associate Haris Joshua Terroe. The session was opened by a keynote speech by Partner Eri Hertiawan, and Partner Simon Barrie Sasmoyo Adiwidagdo, FCIArb shared his experiences in handling foreign-law governed arbitration cases and opined on the current needs of arbitration users in relation to the new SIAC rules. The session also delved into the implications of the recent Constitutional Court Decision No. 100/PUU-XXII/2024 for foreign arbitral awards in Indonesia and key updates in the 2025 SIAC Rules. Speakers shared valuable insights into SIAC’s approach to institutional versus ad hoc arbitration. They also provided practical strategies for businesses to navigate cross-border disputes in light of these developments. Our Partner Eri Hertiawan delivered the keynote presentation on corruption cases. Partner Simon Barrie Sasmoyo Adiwidagdo, FCIArb shared practical tips and his experience in handling anti-corruption in International Arbitration cases. He and Partner M Insan Pratama alongside Clifford & Chance experts led engaging sessions covering Indonesian anti-corruption regulations and insights on US FCPA and UK Bribery Act compliance. Special thanks to our Associate Tengku Sartika Hirsatudya who delivered the detailed presentation materials. The interactive training featured practical case studies and quizzes, helping participants understand key aspects of anti-corruption laws, including the current regulatory framework in Indonesia, elements of corruption, bribery, and gratification, preventive measures and compliance strategies, and cross-border compliance considerations. The regulation refines the audit process by shortening the audit period, expanding auditors’ authority, and clarifying sampling procedures—enhancing both efficiency and legal certainty.
