Important Update on Tax Facilities for Foreign-Funded Projects The Ministry of Finance has issued Regulation No. 80/2024 (PMK-80) on October 18, 2024, detailing procedures for receive VAT and Income Tax facilities that are funded by foreign grants or foreign loan funds. Key points to note: 1. PMK-80 replaces MoF decrees No. 239/KMK.01/1996 and No. 486/KMK.04/2000. 2. Grants or loans must be documented in an agreement, contract, or similar document and registered with a valid registration number. 3. Eligible parties (grant recipients, loan recipients, main contractors, or grant providers of goods/services) can apply for: 🔹 Certificate of Exemption from VAT; 🔹 Certificate of Income Tax Facilities; 🔹Applications should be submitted to the Director General of Taxes via the Head of the Tax Office. Namun, kami berhasil menyusun argumen yang unik dalam mewakili Pemohon Banding, terutama menyoroti ketidakrelevanan dasar hukum yang digunakan oleh Terbanding. Dengan menjelaskan filosofi transaksi syariah, membuktikan independensi transaksi, dan substansi objek transaksinya, kami menunjukkan bahwa dasar hukum yang digunakan Terbanding tidak tepat. Pemohon Banding juga menegaskan bahwa perjanjian Mudharabah dan Murabahah dibuat secara sah dan mengikat sehingga tidak dapat diubah sepihak oleh Terbanding.
