With the new year, Indonesia has officially welcomed 2025 as the Year of Copyright and Industrial Designs. In 2025, the Directorate-General of Intellectual Property aims to promote legal protection for creators and designers.  We are hoping this means that the new Designs Law – which has been in the legislative pipeline for some time now – may finally be enacted. 2024 was of course the Year of Geographical Indications. In 2024, Gayo Arabica Coffee, Amed Bali Salt, and Muntok White Pepper gained global recognition through successful EU registration. The Indonesian House of Representatives (DPR) has finalized its 2025 Priority National Legislation Program (Prolegnas), which includes 41 bills in total, and two key pieces of intellectual property legislation. In 2025 we can expect to see a new Industrial Designs Law which offers a new definition of ‘industrial design’, introduces renewal of design registrations for a total period of up to 15 years, and includes provisions dealing with landlord liability. We are also expecting an updated Copyright Law that imposes harsher penalties for copyright infringement, adapts provisions to address new technologies, and streamlines processes for faster dispute resolution. The Haribo gummy bear, known as the GOLDBEAR, is an example of a three-dimensional (3D) trademark. Originally created in 1922 as the "dancing bear," it evolved into its current form in 1978. SKC Law advised RiGO Trading S.A. on securing a 3D trademark registration in Indonesia. Faced with a preliminary objection from the Trademark Office, our team was able to tweak the trademark specification to achieve a sufficient level of acquired distinctiveness and ultimately, the 3D trademark was successfully registered. This app is designed to offer a more user-friendly and secure banking experience, featuring unique Sharia-compliant functionalities. Already having 100,000 users after two weeks of its launch shows great market interest. We are proud to have supported BSI in securing IP rights for BYOND, from conducting clearance searches to obtaining trademark registrations across various classes. Indonesia has been stepping up its support for WIPO initiatives. On 8 July 2024 Indonesia ratified the WIPO Treaty on Intellectual Property, Genetic Resources, and Associated Traditional Knowledge (GRATK), which seeks to prevent patents involving genetic resources and the traditional knowledge from being granted. Additionally, Indonesia is registering the Indonesian Culture Collection (InaCC) as an International Depositary Authority (IDA) to enhance its global role in managing genetic resources. The Indonesian Culture Collection (InaCC) is a national depository for microorganisms, managed by the Microbiology Division of the Research Center for Biology under the Indonesian Institute of Sciences (LIPI). Celebrate with us 😊🎉 Trademark cases account for over 70% of intellectual property litigation in Indonesia. This reflects the high number of applications for registration of trademarks filed at the IP Office relative to other intellectual property rights. Most of those cases are trademark cancellations, and many involve bad faith registrations. Civil infringement and non-use proceedings are rare. They are often difficult, but not always, and we have a few tricks up our sleeve - such as citing regulatory non-compliance as prima facie evidence of non-use - that can improve prospects of success. In Indonesia, trademark rights—whether registered or pending — are transferable through inheritance, as outlined in Article 41 of the Trademark and Geographical Indications Law (UU MIG). A valid transfer requires a Deed of Transfer signed before a notary and submission to the DGIP for legal protection. Transfers may occur via inheritance, wills, donations, or legal agreements. If a trademark owner passes away during the registration process, the application can still transfer to heirs, safeguarding these IP assets.
