  • From 30th September 2025, 𝐀𝐮𝐭𝐨-𝐄𝐧𝐫𝐨𝐥𝐦𝐞𝐧𝐭 (𝐀𝐄) will provide workers with an additional retirement savings scheme, complementing the State Pension. ✅ 𝐖𝐡𝐲 𝐀𝐮𝐭𝐨-𝐄𝐧𝐫𝐨𝐥𝐦𝐞𝐧𝐭? With only 35% of private sector workers covered by pensions, AE will ensure more people can maintain their living standards in retirement. ✅ 𝐖𝐡𝐨 𝐢𝐬 𝐄𝐥𝐢𝐠𝐢𝐛𝐥𝐞? Employees earning over €20,000 per year, aged 23-60, and not already in a workplace pension. Part-time and seasonal workers are also included. ✅ 𝐂𝐨𝐧𝐭𝐫𝐢𝐛𝐮𝐭𝐢𝐨𝐧𝐬 Employee and employer contributions start at 1.5%, rising to 6% over 10 years. The State will contribute an additional 1/3 of employee contributions. This "living document" reflects the latest legal and labour market developments, including updates following the Supreme Court judgement in the 𝘙𝘦𝘷𝘦𝘯𝘶𝘦 𝘊𝘰𝘮𝘮𝘪𝘴𝘴𝘪𝘰𝘯𝘦𝘳𝘴 𝘷 𝘒𝘢𝘳𝘴𝘩𝘢𝘯 (𝘔𝘪𝘥𝘭𝘢𝘯𝘥𝘴) 𝘓𝘛𝘋 𝘛/𝘈 𝘋𝘰𝘮𝘪𝘯𝘰’𝘴 𝘗𝘪𝘻𝘻𝘢 [2023] 𝘐𝘌𝘚𝘊 24 case and the introduction of the five-step framework. Correctly determining whether a worker is an employee or a self-employed contractor is crucial for ensuring they receive their rightful protections and benefits. Misclassification not only impacts workers and their employment rights but also reduces contributions to the Social Insurance Fund. The Code aims to support employers, employees, independent contractors, HR professionals, and legal and financial advisors by outlining the rights and obligations tied to different employment arrangements. It also recognises the vital role of genuine self-employment in the economy, ensuring independent contractors are not unnecessarily classified as employees.   • The Maternity Protection, Employment Equality and Preservation of Certain Records Act 2024 has been signed into law by the President. We are waiting for the commencement order which will specify the date(s) on which the new legislation will become effective. Here is what employers need to know: 𝐏𝐨𝐬𝐭𝐩𝐨𝐧𝐞𝐦𝐞𝐧𝐭 𝐨𝐟 𝐌𝐚𝐭𝐞𝐫𝐧𝐢𝐭𝐲 𝐋𝐞𝐚𝐯𝐞 𝐟𝐨𝐫 𝐒𝐞𝐫𝐢𝐨𝐮𝐬 𝐇𝐞𝐚𝐥𝐭𝐡 𝐂𝐨𝐧𝐝𝐢𝐭𝐢𝐨𝐧𝐬: 👉 Employees can postpone maternity leave for up to 52 weeks due to a serious health condition. 👉Notice must include specified dates and a medical certificate, provided at least 2 weeks in advance. 👉An employee who has postponed all or part of their maternity leave, may notify their employer a second time of their intention to postpone their maternity leave. This second postponement must be to a date that is no later than 52 weeks from the date on which the first postponement commenced. 👉An employee cannot postpone their maternity leave under both this provision and under section 14B (i.e. in the event of the hospitalisation of a child) in respect of the same birth. 𝐑𝐞𝐬𝐭𝐫𝐢𝐜𝐭𝐢𝐨𝐧𝐬 𝐨𝐧 𝐍𝐨𝐧-𝐃𝐢𝐬𝐜𝐥𝐨𝐬𝐮𝐫𝐞 𝐀𝐠𝐫𝐞𝐞𝐦𝐞𝐧𝐭𝐬 (𝐍𝐃𝐀𝐬): 👉NDAs regarding discrimination, victimisation, harassment, or sexual harassment will be null and void unless specific conditions are met. 👉Conditions include employee-requested agreements, independent legal advice, employer-paid legal costs, and withdrawal rights within 14 days. 👉NDAs must allow disclosures to professionals such as Garda, lawyers, medical experts, and trade union officials.   • A recent decision by the Workplace Relations Commission (WRC) has shed light on how remote working disputes are being adjudicated in the wake of the Work Life Balance and Miscellaneous Provisions Act 2023, as per the Irish Independent article below. The WRC ruled that it was “reasonable” for a Kerry-based employee, previously on a fully remote contract, to be required to attend the employer’s Dublin office once a month. This case, only the second under the new legislation, highlights how under the Code of Practice it is not the outcome of the decision that matters the most, but the process that is properly followed. In this context, the Adjudicator determined that the employer had met its legal obligations by conducting an assessment that balanced the business’s needs with the employee’s needs. This ultimately resulted in a significant adjustment from the business's original preference of working in the Dublin office two times per week to once a month to accommodate the employee's requirements. Some of the most typical symptoms of menopause include psychological issues such as mood disturbances, anxiety and/or depression, memory loss, panic attacks, loss of confidence, reduced concentration, hot flushes, sleep disturbances, night sweats and headaches. Those experiencing symptoms can be deeply affected leading to difficulties with concentration, fatigue, and managing daily tasks which may impact their overall productivity and well-being at work.
