The U.S. Department of Labor’s proposal to phase out subminimum wages under the Fair Labor Standards Act has prompted speculation about the agency's authority and the potential political implications. Future "Department of Government Efficiency" (DOGE) leader Elon Musk sparked an online uproar last week with his call to eliminate the Consumer Financial Protection Bureau (CFPB). In a statement for Law360, Clark Hill Law Member Joann Needleman acknowledged that lawmakers should take a "fresh look" at how financial federal regulatory agencies may overlap, but she advised “[it] is unwise to leave a regulator vacuum at the federal level only to have the states fill in with inconsistent guidance and enforcement."
