Fieldfisher Ireland LLP, on behalf of its client, Coucal Limited, has recently been successful in securing leave to appeal to the Supreme Court of Ireland. The case involves important issues which touch on the assignment of bare rights of action, champerty and maintenance, how litigation is constituted and how Irish law interacts with EU law regarding, the enforceability of EU judgements in these areas. It is anticipated that the full hearing of the matter will come before the Supreme Court in the first half of 2025. As readers will recall, the Sick Leave Act 2022 provides for a statutory sick pay (SSP) scheme for all employees, subject to a few conditions. From 1 January 2024, the entitlement is 5 days paid SSP. Many employers will already have company sick pay schemes in place. In such cases, if the company sick pay scheme is, as a whole, more favourable to employees than SSP, then employees will not be entitled to also benefit from SSP. So, how does an employer know whether or not its company scheme is more favourable? Well, helpfully, the Sick Leave Act 2022 sets out the various factors to take into consideration in that sense. The recent WRC case of Ann Britton v Amcor Flexibles Ltd (ADJ-00050138) serves as a reminder to employers that offering a relatively favourable company sick pay scheme may still not be sufficient to disentitle employees to SSP. The employer in this case claimed that the company sick pay scheme overall was more beneficial than SSP, and that, therefore, the employee had no entitlement to payment under the SSP scheme. However, it was noted that the statutory scheme provided a 13-week qualifying period and the employer scheme provided a 52-week qualifying period. The Adjudicator held that "In this case, given the total absence of any payment during the reference period of the 52-week exclusion period specified in that contract, the Respondents scheme did not confer benefits which were, on the whole, more favourable than the statutory sick leave of five days paid leave..." Each employer’s scheme will need to be assessed on a case by case basis, considering those specific factors identified in the Act, including the waiting / qualifying period. Employment law advice should also be sought, if in any doubt. Lastly, employers should also note that it is proposed that the SSP entitlement will increase to 7 days for 2025 and to 10 days for 2026! At Fieldfisher Ireland LLP , we are proud to support Hometree, our environmental charity partner, in their mission to conserve Ireland's permanent native woodlands and promote land regeneration and biodiversity through afforestation, restoration, and education. To gain firsthand insight into Hometree’s impactful environmental restoration efforts, a group of our dedicated staff recently volunteered at their Avoca site in Wicklow. This immersive experience allowed our team to actively participate in essential conservation tasks, including tree planting and preservation work. The day provided a valuable opportunity to learn more about Hometree’s operations and the tangible difference their work makes in protecting Ireland’s natural ecosystems. This initiative was generously funded by the Just Purpose team in the UK, whose support continues to advance our collective commitment to environmental sustainability.
