The Delhi Commercial Court held that Section 12 of The Arbitration & Conciliation (Amendment) Act (2015) would be applicable to arbitral proceedings initiated prior to the aforementioned amendment's enactment as well; on 28 Oct, 2024. The case involved a challenge to a 2017 arbitral award favouring the respondent where the petitioner argued that the sole arbitrator, a serving employee of the respondent, was unilaterally appointed, infringing Section 12(5) of The A&C Act & principles of natural justice. The Court found that the arbitration clause explicitly allowed for amendments to the A&C Act to govern proceedings, thereby including the 2015 amendment. The Court concluded the arbitrator to be ineligible, resulting in the award being unsustainable, & set aside the impugned award. #arbitrationawards
