Bridge Policy Think Tank is Public Policy Advisory & Research, Advocacy, Capacity Building and Conflict Management organisation. We assist ministries in drafting legislations based on statistical data research, global best practices. We are one of the pioneers in organized civil and commercial mediation, policy advisor, think tank and training in India. When Influencers Become Targets: The Hidden Struggle for Justice Under India’s PoSH Act A popular social media influencer was filming a video in a bustling market when the unthinkable happened, she was groped by a man. Stunned and overwhelmed, she froze, knowing she had just been violated but unsure where to seek help. As an influencer without a traditional employer or HR department, accessing justice became a complex challenge. This incident highlights a larger issue for gig workers, influencers, and women in the unorganised sector, who face increased vulnerability to workplace harassment. While the Prevention of Sexual Harassment Act, 2013 (“PoSH”) offers legal protections, navigating the system remains difficult. Women in the informal sector are required to file complaints with Local Complaints Committees (“LCCs”). However, with only 29% of districts having established LCCs and many victims unaware of their existence, justice remains out of reach for most. This points to an urgent need for reform: LCCs must be strengthened, better funded, and adequately trained to handle harassment cases with sensitivity and efficiency. These critical issues were discussed on November 8, 2024, at a panel hosted by the Vijay Foundation on "Empowerment of Women: PoSH Challenges and Concerns." Moderated by Bridge Policy Think Tank’s honorary director, Ms. Kritika Krishnamurthy. The session featured distinguished panellists, including Hon'ble Justice Neena Bansal Krishna, Ms. Vimla Mehra, IPS officer (Retd) and Ms. Nandani Rao, Social Rights Activist. They delved into the challenges of enforcing PoSH, particularly in the unorganised sector, and called for stronger legal frameworks to ensure the safety and dignity of all workers. GIFT City: The Next Global Hub for Dispute Resolution Decades ago, Indians with serious medical issues traveled to the United States for treatment because advanced medical care was not available in India. Today, India is a global hub for medical tourism, providing world-class healthcare at a fraction of international costs. What once cost India billions in outbound medical expenses has evolved into a multibillion-dollar industry that serves patients from across the globe. Just as India transformed its healthcare landscape, it has the potential to become a global leader in alternative dispute resolution (ADR), offering world-class services at competitive prices. Today, what is costing India heavily in outbound ADR expenses could evolve into a thriving global industry, attracting disputants worldwide. The Union Budget for 2022-23 proposed establishing an International Arbitration Centre in GIFT City for the timely resolution of disputes under international jurisprudence. To compete with established international alternative dispute resolution centres (IADRCs) in Singapore, London, Hong Kong, and Dubai, the GIFT City Centre must offer services that meet or exceed these venues in quality, cost, and efficiency. Furthermore, it should introduce unique value propositions to set it apart in the global ADR space.
