  • 𝗖𝗲𝗹𝗲𝗯𝗿𝗮𝘁𝗶𝗻𝗴 𝗮 𝗝𝗼𝘂𝗿𝗻𝗲𝘆 𝗼𝗳 𝗟𝗲𝗮𝗿𝗻𝗶𝗻𝗴, 𝗝𝗼𝘆 𝗮𝗻𝗱 𝗜𝗻𝘀𝗽𝗶𝗿𝗮𝘁𝗶𝗼𝗻!   From December 25, 2024, to January 1, 2025, 100 students from the Brahma Savitri Veda Vidyapeeth, Pushkar and Government School, Balada (Beawar) embarked on a remarkable educational tour under the aegis of ‘Shri Chiranji Lal Jhanwar Memorial Educational Tour’ organised by the Chir Amrit Foundation, Jaipur.   The 8 day tour was filled with learning, discovery, excitement and happiness while the students experienced the life-enriching journey through Jaipur, Agra, Vrindavan, Prayagraj, Varanasi, and Ayodhya, creating memories that will last a lifetime. 💫   The students also participated in interactive and thought provoking sessions on topics such as Artificial Intelligence, personality development, body language, and emotional hygiene, conducted by Sanjay Jhanwar, Sr. Advocate Sir and Shruti Jhanwar.   As part of New Year’s celebration, the students lit up the stage with captivating performances in drama, dance, singing and cricket, showcasing their talent and energy. During the concluding ceremony, certificates were distributed to all the students and prizes were awarded to the outstanding performers. The sponsors and supporters of the tour including the office bearers of the Uday Hostel were also felicitated by the students as a token of gratitude, highlighting the collective effort behind this impactful initiative.    Initiatives like these remind us why we are committed to making education a joyful journey for every child. We successfully represented the Resolution Professional of Maha Associated Hotels Pvt Ltd before the Hon’ble NCLAT, New Delhi. Hon’ble NCLAT, New Delhi, observed when Suspended Management itself failed to adhere to the CIRP Regulations in submission of their own resolution plan, then suspended management cannot be allowed to nit-pick on imaginary irregularity committed by RP. Further, it was observed that no copy of resolution plan submitted by other PRA’s could have been shared in advance with Suspended Management as it would have triggered conflict of interest. At last, it was observed that Suspended Management cannot go into technical issues regarding evaluation and score matrix, falling withing the exclusive domain of CoC. Our first stop was Jaipur, where we got a chance to explore Albert Hall Museum, Jantar Mantar, Govind Dev Ji Temple and the renowned Printing Unit of Rajasthan Patrika. Apart from the primary objective of providing requisite exposure to these young minds, we are thrilled to structure our program in a manner to teach multidisciplinary skills to the students, to enable them to carry out interdisciplinary tasks. The curriculum as well as teaching style of both schools is completely different. While one focuses on standard teaching pattern of different subjects, the other is rooted in our traditional teachings of Vedas. Hence, to ensure that both set of students get to learn from learned teachers of the other school, we undertook a groundbreaking initiative of the teacher exchange program between two schools. The teachers of Ved Vidyalaya taught Sanskrit pronunciation and Ganpati Stuti to the students of Government School using innovative methods to engage the students and help them grasp the complexities of the ancient language. Similarly, the teachers from Balada conducted a workshop on English tenses, using real-life examples and interactive exercises to make the concept more accessible and fun for the students of Ved Vidyalaya. This activity demonstrated the value of a multidisciplinary approach to education, where different subjects and disciplines are interconnected. This activity is an integral part of Corporate Social Responsibility of our firm's tradition. It provides a unique opportunity for our team members to explore various regions of India, gain valuable insights, foster camaraderie and learn the intricacies of psychology through interacting with young creative minds. The Hon'ble Rajasthan High Court passed an interim order in favor of M/s Gyankeer Tobacco, providing crucial relief against exorbitant GST, Cess and Excise demand to the tune of Rs. 195 Crores plus interest and penalty. The arguments for the petitioner were led by Sr. Adv. Mr. Mukul Rohatgi and Mr. Sanjay Jhanwar, Sr. Advocate and our team consisting of Senior Partner Adv. Rahul Lakhwani, along with Adv. Wilson Joy, Adv. Shreya Jhanwar and Adv. Mihir Jhanwar. We submitted before the Hon’ble High Court that the advance ruling passed under Section 97 by the SGST Dept. classified Petitioner’s product under CTH 2401 20 90- Others attracting GST @ 28% and Compensation Cess @ 71%, was challenged by the CGST Dept. under Section 104 and 107 proceedings on the aspect of classification and rate of GST & Excise, however, the advance ruling was sustained and attained the status of law. We further argued that in such a scenario, issuance of the impugned SCNs under Section 74 proposing different classification and demanding Cess and Excise Duty at higher rate by the same authority despite having lost at two forums previously, was wholly without jurisdiction and contrary to the principles of fairness. The Hon’ble High Court appreciated the merits of our arguments and observed that the case prima facie involves a legal issue for consideration.   • 𝗛𝗢𝗡’𝗕𝗟𝗘 𝗧𝗥𝗜𝗕𝗨𝗡𝗔𝗟 𝗗𝗜𝗦𝗠𝗜𝗦𝗦𝗘𝗗 𝗧𝗛𝗘 𝗦𝗘𝗖𝗧𝗜𝗢𝗡 𝟭𝟳 𝗔𝗣𝗣𝗟𝗜𝗖𝗔𝗧𝗜𝗢𝗡 𝗦𝗘𝗘𝗞𝗜𝗡𝗚 𝗨𝗥𝗚𝗘𝗡𝗧 𝗜𝗡𝗧𝗘𝗥𝗜𝗠 𝗥𝗘𝗟𝗜𝗘𝗙𝗦 𝗜𝗡 𝗔𝗡 𝗜𝗡𝗧𝗘𝗥𝗡𝗔𝗧𝗜𝗢𝗡𝗔𝗟 𝗖𝗢𝗠𝗠𝗘𝗥𝗖𝗜𝗔𝗟 𝗔𝗥𝗕𝗜𝗧𝗥𝗔𝗧𝗜𝗢𝗡 In a significant matter of International Commercial Arbitration, the Hon’ble Arbitral Tribunal presided over by Mr. S Muralidhar, Retd Chief Justice (Hon’ble Orissa High Court) dismissed the application filed by the Claimant under Section 17 of the Arbitration and Conciliation Act, 1996 whereby the Claimant sought urgent interim directions against the Defendant to furnish a bank guarantee of USD 669,040.70 in order to secure the disputed claim amount on an apprehension that the Respondent is not financially sound, and the Claimant would not be able to recover the arbitral award amount, if passed in favour of the Claimant. We represented our Client, Yash Refractories and made submissions that twin conditions for grant of relief under Section 17 is not met with for grant of interim relief as there is no evidence reflecting alienation of assets by Respondent as well as distressed financial condition of Respondent. Upon appreciating our submissions, Hon’ble Tribunal held that some material would have to be shown to the Tribunal which would indicate that the Respondent is taking steps to disperse or dispose of its assets with an intent to defeat any award that may be ultimately passed. Further, Tribunal held that the party claiming relief under Section 17 tantamount to an attachment before judgment under Order 38 Rule 5 of CPC, and therefore Party has to establish not just a prima facie case but a strong one. We have successfully represented the Resolution Professional of Vinergy International Pvt Ltd. before the Hon’ble NCLT Mumbai seeking approval of Resolution Plan under Section 30(6) read with Section 31 of Insolvency and Bankruptcy Code, 2016 . We have successfully managed to apprise the Hon’ble NCLT Mumbai about the salient features of Resolution Plan along with its viability for the stakeholders. Further, Tribunal is pleased to note that Plan is not in contravention of any of the provisions and Regulations of the Insolvency law. Upon appreciating our submissions, NCLT Mumbai deemed fit to approve the Resolution Plan. Throughout the process of CIRP, our team has advised the Resolution Professional and actively contributed to successful closure of CIR Process.
