At Chir Amrit Legal LLP we successfully represented M/s Amol Pharmaceuticals Pvt. Ltd. in a landmark case before the Hon'ble Delhi High Court, addressing the arbitrary withholding of IGST refund by the Customs Department. Our team’s diligent efforts have resulted in a favorable ruling, directing the Department to sanction the refund and award interest on the delayed payment. Case Highlights: * The IGST refund, originally withheld due to alleged invoice mismatches, was ordered for release as the exports were made in compliance of Section 16(3)(b) IGST Act and Rule 96 CGST Rules and no case otherwise was made out by the Department. * During the proceedings the Hon’ble High Court observed that no delay was attributable to the exporter for submitting the details of exports proceeds which was being disputed by the Department for not granting interest on the delayed payment of refund. Consequently, the Department has been instructed to process the interest claim of the Petitioner as well. This ruling is a breakthrough for exporters across India, reinforcing their rights to timely refunds and interest on any undue delays. Our client faced allegations of #GST =evasion due to differing interpretations of taxable amounts on the platform’s earnings. Case Highlights: - The applicant was charged for failing to pay GST on the entire pooled prize money for online games like Ludo, as per Rule 31A and 31B of the CGST Rules. - Our team argued that the Department’s interpretation was arbitrary and that the arrest and prosecution provisions invoked were not applicable in this case as the same involved question of validity of the rule itself for being contrary to the basic principles of taxation. - The Hon'ble Rajasthan High Court appreciated our arguments, especially in light of recent Supreme Court rulings on procedural fairness, and granted bail. The Hon'ble Supreme Court has upheld the Rajasthan High Court's ruling in favor of SBI, dismissing the Special Leave Petition (SLP) filed by the Sales Tax Department. Our team, led by Sr. Advocate Sanjay Jhanwar, Sr. Advocate, Senior Partner Rahul Lakhwani, along with Wilson Joy and Aditya Sharma, effectively argued that the Notification No. F-4(69) FD/Tax/Div./95-46, dated 15.03.1996, which grants sales tax exemption on gold bullion exports, stands independently of the 26.03.1999 notification that pertains to intra-state sales. This crucial distinction safeguarded the tax exemption on SBI’s exports. In a significant ruling, the Hon'ble Rajasthan High Court provided interim relief to our client, Ruchi Gupta, allowing her to contest the upcoming election of the 25th Central India Regional Council (CIRC) of ICAI. The Petitioner had challenged the rejection of her nomination, which was based on alleged "non-genuine" signatures, without clear records or explanations. Despite holding the position of Treasurer at ICAI's Jaipur branch, where her signatures are present on official documents, this evidence was overlooked by the Panel. The High Court recognized these facts and issued notice to the Panel, ensuring her right to contest the election.
