Delhi High Court Delivers Landmark Judgment on Sports Code: Kochhar & Co. Secures Critical Ruling Advancing Governance, Inclusivity, and Transparency in Indian Sports • Are Horses Athletes or Equipment? Delhi High Court Settles the Issue. • Power to Relax Provisions of the Sports Code Cannot Be Exercised Arbitrarily and Without Application of Mind, Rules Delhi High Court. • Exemptions Granted to the Equestrian Federation of India (EFI) Must Align with Principles of Good Governance; Held to Be Arbitrary. Kochhar & Co. is proud to have represented the Rajasthan Equestrian Association in this landmark case. The petitioners were ably represented by Mr. RAJIV DUTTA, Senior Advocate, alongside Mr. Ashish K., Partner, and Mr. Balasubramanian Ramesh, Senior Associate, from Kochhar & Co. Key Takeaways from the Judgment: • The Court upheld the legality of the “Relaxation Clause” but restricted its scope, ruling that such powers must be exercised judiciously and based on sound reasoning. • Exemptions granted to EFI were found to be arbitrary and inconsistent with principles of good governance and inclusivity. It was held that equestrian sports' unique demands do not exempt them from established governance standards. • Club-based governance diluted grassroots representation by state and district associations, contravening the pyramidical structure mandated by the Sports Code. • The Court resolved the long-standing debate on whether horses are athletes or equipment, clarifying that they are categorised as equipment under the Sports Code. Significance of the Judgment: To address governance deficiencies identified in EFI’s operations, the Court directed the formation of a Fact-Finding Committee, chaired by a retired Delhi High Court Judge, tasked with reviewing EFI’s governance practices, infrastructure, functioning of state associations, the role of clubs, and athlete participation within a three-month timeframe. This ruling reinforces accountability among National Sports Federations (NSFs) and provides a framework for promoting grassroots development and inclusivity in Indian sports governance.
