Founded by Shri V. Lakshmikumaran and Shri V. Sridharan, Lakshmikumaran & Sridharan has been a leading law firm in India since 1985. Unpacking the complexities of arbitration law, this monograph explores the debate over unconditional stays of arbitral awards under Section 36(3) of the Arbitration and Conciliation Act, 1996. Examining key judicial decisions, conflicting interpretations by the courts and the prevailing ambiguities in this area of the law, it attempts to explain the legal position on this point and the need for clarity. The analysis presented here by Aniruddha A.S. , Associate Partner and Sagar Agrawal, Associate in LKS Bengaluru, suggests that unconditional stays of an award can indeed be granted.
