About us

LCGN was founded in 2012. It moved into the current Chambers practice in 2021. We currently have 10 qualified lawyers (some of whom carry the additional qualification of patent agents as well) and 6 support staff. Our practice areas span commercial litigation, with a significant portion of if in patent litigation. We also dedicate around 30% of our resources and time to non-fee based work including in service and criminal law matters. We are noted for the unique skill set of marrying the client's commercial needs to solutions in law and our success rate across litigation and other contentious domains is over 90%. We are based out of the National Capital Region, Delhi, and our practice is pan-India with cases in Mumbai, Bengaluru, Hyderabad, Shimla, Kolkata, etc.

  • #AIBE #wishes to the six bright buttons of LCGN LLP and to the millions (probably) young hopefuls giving the All India Bar Exam tomorrow - good luck and the bestest of wishes. If you clear the exam, fantastic. If you do not, it is not the end of the world. Heck - I probably would not clear it if I wrote it today. It is an exam - no more no less. One of the brighter buttons I have working with me missed his first try due to the strangest of circumstances - and is way better as a lawyer than even those with 15-20 years' experience. Missing the paper, or not clearing it is not a reflection on your talent/ability/potential as a lawyer :: It's an exam and there is always another one around the corner Good luck again and have fun. If you know the answers, it's fun writing them down. If you do not know the answers, you can always do what I did way back in the day when I wrote the IIT Entrance. The first paper was maths - I did not know a single answer. Had fun doodling images of zoo critters and aliens across the first two sheets, then walked out to see a Rajni matinee - and had even more fun.

Key takeaways: - speech has to be responsible - check facts before speaking - social media speech - no matter how many likes/loves/supports/lightbulb learning emojis are garnered still has to be backed by hard facts/data. Basically, claiming "special knowledge" based on fluent articulation in English is insufficient if not backed by facts and/or qualifications. Kudos, a hat tip and respect to Sagar Chandra and his team for the evident hard work that has gone in preparing for this case and for the result.

Positions available: October: 2. November: subject to continuance of October-engagements: 3 Type of Internship: Physical. Do NOT apply if you want to work online. Selections are subject to an interview - physical/online, depending on mutual convenience. Stipend: We pay. What we pay is between us and the selected candidate(s). It's not peanuts. It's not 'Cash"ewnuts either. It's somewhere in between. What we look for: a. Ability to think and work hard b. Inquisitiveness about law, legal developments c. Discipline, dedication to the work allotted, and a passion for learning. Who/What we do not want: a. James Bond aka 007 varietals [0 discipline, 0 integrity and 7 lunch breaks] b. What we will give: a. exposure to different areas of law b. exposure in drafting [not as arbit academic exercises but actual case-based] applications, pleadings, and documentation - subject to written confidentiality requirement. c. training on how to work on a litigation/potential litigation scenario - including how to determine and analyse when, and more importantly, if the client should sue/defend. In effect, an exposure to the commercials underlying commercial litigation. [Commercial, particularly IP litigation is not about oratory or YouTube/Twitter/LinkedIn posts but about crafting a solution for specific commercial problems] d. a fairly healthy work atmosphere [only if you have a decent tolerance for random Bad Dad jokes and do not react except with rolling-eyes] e. a fairly easy work schedule. It's a 9.15 to 7.00 PM most days Disadvantages: a. Tea/Coffee only thrice a day. Other beverages not allowed b. No time for Social Media such as Insta/SnapChat/LinkedIn etc. in office hours c. Hearing horrible puns and occasionally comprehensively irreverent rants qua things that the sheeple hold holy. d. But that apart, in so far LCGN LLP is concerned Attention! Attention! Attention! We have a zero-tolerance policy towards: -         Practicing use of Cannabis indica [aka hemp, Mary Jane, Grass, Weed] in any form whatsoever; and also -         Practicing use of Cannibalism indianicus [aka eating each other’s brains during office hours, or worse still, eating my brains with bleating about work-life balance; removing the name of the lawyer who worked from appearance slips and inserting one’s own; “copy-paste” in any form for eg. copying and pasting; copying when pasted; etc] LCGN LLP may encourage and motivate all to go the गंजा way.   • #eltrombopag #genus v #species #Division_Bench Sharing the Eltrombopag Judgment of the Hon'ble Division Bench - published just a little while ago. The Hon'ble DB rightly identifies the primary ground of invalidity as Section 3(d) in base-salt cases, and sets aside the Single Judge grant of injunction. Critically, it does not rule on Section 53(4) aspect which has been extensively relied on in various cases for various grounds. On coverage v. disclosure, it appears to reaffirm the absolute applicability of AstraZeneca v. Intas (DHC DB) and points out the distinction from the earlier MSD v Glenmark (DHC DB) The key takeaways and thankfully so for me are the reaffirmation of the fundamental tenet that grant of patent does not lend itself to a presumption of validity at interim stage. Critically, the Judgment sets out the fact that the procedure of grant at IPO has to be kept aside when testing validity at interim stage. Paragraph 102 would appear to lay a higher burden in genus-species cases. We will need to see how this goes forward - is it going to be necessary to see prior claiming not as a legal construct but as a fact-evidence based enquiry requiring expert evidence?? Needless to add, I am immensely grateful to my colleagues @Shashikant Yadav and Rahul Bhujbal - who have been pillars of strength through this particular theater of the genus-species war - providing unstinted moral, intellectual and practical support in creating the strategy adopted for the client. It would be churlish to not acknowledge the high level of professionalism shown by the Counsel for Novartis - as ever Hemant Singh, Mamta Jha, Garima Mehta and @Siddhant Sharma stand out for the levels of courtesy displayed before, during and after the hearings. The level of independent and pleading- based enquiry that appears to have gone in is highly educative - and shows the significance of being able to write a good pleading - a pleading that is fair, and based on hard facts and law.
