🎉 Celebrating a Decade of Excellence at Orbit Law Services! 🎉 We are thrilled to share the highlights from our 10th Anniversary Celebration held at the Yashwatrao Chavan Centre, Mumbai, on 5th October 2024. It was an unforgettable event filled with meaningful discussions with valued clients. On the eve of our 10th Anniversary, we invited our clients and well-wishers to hold panel discussions on “Legal Issues in Stressed Assets Management & Debt Recovery in the Backdrop of Insolvency Laws” sparked insightful conversations and provided invaluable perspectives. In the first panel discussion, we discussed, how the stressed asset can be managed once it is turned from a Financial Asset to a Stressed Asset as per the various guidelines. The concept of the Board for Industrial and Financial Reconstruction (BIFR) under the Sick Industrial Companies Act (SICA), 1985, Corporate Debt Restructuring (CDR), One Time Settlement (OTS) and One Time Restructuring (OTR) culminating in IBC default resolutions was discussed in detailed from the lender’s perspective. The second panel discussion was based on issues being faced by the bankers, and law firms and technical hurdles at recovery tribunals and mechanisms to be adopted by banks to overcome such challenges. The Third-panel discussion was made interesting with a debate on whether Insolvency Resolution under the Insolvency Bankruptcy Code should be seen as a mode of recovery or Resolution and the impact of IBC on stressed asset management and recovery, especially in the infrastructure sector and the role of COC therein. Overall, all three panel discussions were full of knowledge sharing and brainstorming.
