In a significant ruling, the Delhi High Court protected Opella Healthcare’s well-known trademark “PHENSEDYL” against the deceptively similar “PHENSERYL.” The Court annulled the Respondent’s trademark and copyright, citing visual and phonetic similarity likely to confuse consumers. An injunction was also granted restraining the Respondent from using the infringing mark in any form.
